Nate Staudt recently secured a permanent total disability award on behalf of a client who suffered catastrophic, life-altering injuries in an unwitnessed workplace accident that left him permanently unable to return to work. Following an arbitration hearing before the Iowa Workers’ Compensation Commissioner, the decision ensures that the client will receive weekly benefits for the remainder of his life while preserving access to the medical care and treatment he will continue to need as a result of his injuries. Nick represented an injured worker where the defendant employer and workers’ compensation carrier denied that her injuries were causally related to work. Nick filed suit and took the case to hearing before an administrative law judge (ALJ). The ALJ favorably determined that the client’s injuries were indeed causally work-related and awarded the client approximately $60,000 in back healing period benefits (i.e., benefits paid during a period of recovery). Once the client recovered from her injuries, Nick again filed suit to have the issues of extent of permanent disability and loss of future earning capacity heard before a judge. Nick took this second case to hearing as well, but before a decision was entered by the ALJ, the Defendants agreed to pay the injured worker an additional $400,000 to resolve her remaining claims. It took two administrative hearings and nearly three years of fight, but wrongs were righted for this very deserving client.
