As AI-enabled tools become embedded in vendor offerings across the healthcare sector, organizations must confront a critical but often overlooked question: who owns the data, and what can the vendor do with it? HIPAA does not assign ownership of data. Apart from individuals’ right to access their own protected health information (“PHI”), it governs how data may be used and disclosed, so ownership and data-use rights must be set by contract.
