Attorney Ben Stone recently represented a very young man facing five years in prison for violating his probation several times. The client, who graduated HS while in custody, had already lost his deferred judgment due to his guilty pleas to two new crimes, with another one pending. Both his probation officer and the prosecutor were arguing for revocation and prison. But after the judge saw the eight exhibits Stone gathered, and heard testimony from the young man, the court agreed to spare him prison by sending him to a residential treatment facility instead. The Iowa Association for Justice awarded Al Smith the 2026 Lisa Davis-Cook Golden Hard Hat award in recognition of his “courageous and timely advocacy in federal court, taking on the full weight of the federal government to defend the rights of immigrants and uphold the rule of law.” Al “exposed unlawful detention practices, vindicated fundamental due process rights, and forced accountability where it was resisted, securing freedom for [his] clients and shining a light on injustice.”

Attorney Gina Messamer received the same award in 2025 for her defense of the First Amendment. Here are Gina and Al celebrating as she gives him the hard hat for the next year.

Today, Al Smith won two federal habeas petitions, securing the immediate release of one immigrant client and a bond review for another immigrant client. In another case, the court awarded his client attorney fees under the Equal Access to Justice Act. If you or someone you love has been detained by ICE, you want an attorney who is experienced with complicated federal litigation and will keep fighting even after your release so the government has to pay for forcing you to file suit.
