Four years ago, a judge threatened us with jail if we kept speaking to the press and public about CPS misconduct in two of our most tragic dead child cases. In response to the jail threat, we retained a team of top attorneys to file a successful federal lawsuit, striking Colorado’s unconstitutional criminal sanctions against speaking out in such cases.
Over the last four years, we’ve relied upon our renewed First Amendment rights to help expose CPS caseworker misconduct, including an ongoing Denver case where one CPS caseworker now faces several felonies for fabricating child s*x abuse reports.
Legal change is never swift, so it’s exciting to finally announce that the state legislature has, at long last, amended C.R.S. 19-1-307 to better preserve the rights of grieving parents, and their lawyers, to demand CPS accountability. This is an important first step, but far from the only step, we need to take to protect Colorado’s most vulnerable kids.
