Yesterday, after a five-day trial, a Larimer County jury unanimously entered an award of $65M against the Defendants for wrongful death damages.

Their verdict represents the largest Larimer County jury verdict and the largest trucking crash jury verdict in Colorado.

Like most states, Colorado requires drivers to maintain minimum amounts of liability insurance, which covers bodily injury to another person or property damage to someone else’s vehicle when the insured is at fault for an accident.

Failing to maintain this minimum amount of liability insurance is illegal and can subject the driver to fines and a loss of their driving privileges.

Default judgment was entered in favor of our clients in the sum of $1,750,000, plus statutory interest. Based on the deemed admitted facts and the evidence presented at a C.R.C.P. 55(b) damages hearing, the Court found that the evidence presented by Plaintiff proved circumstances of willful and wanton conduct by Defendant. As such, the Court awarded an additional $1,000,000.00 in exemplary damages pursuant to C.R.S. § 13-21-102(1)(a).
