Legal Q&A | 𝗖𝗮𝗻 𝗮𝗻 𝗘𝗺𝗽𝗹𝗼𝘆𝗲𝗲 𝗥𝗲𝗳𝘂𝘀𝗲 𝘁𝗼 𝗦𝗶𝗴𝗻 𝗮 𝗪𝗿𝗶𝘁𝘁𝗲𝗻 𝗪𝗮𝗿𝗻𝗶𝗻𝗴?

Yes. An employee can refuse to sign a written warning or disciplinary notice. However, in most cases, signing a warning does not mean the employee agrees with its contents. It simply acknowledges that the document was received and discussed.

If an employee refuses to sign, employers should document the refusal. Many companies note on the form that the employee declined to sign and have a manager or witness verify that the warning was presented.

Why does it matter?
• A refusal to sign does not automatically invalidate the warning.
• Employers should maintain clear documentation of disciplinary actions.
• Employees may have the opportunity to provide a written response if they disagree with the warning.

𝗘𝗺𝗽𝗹𝗼𝘆𝗺𝗲𝗻𝘁 𝗟𝗮𝘄 Q&A

Q: Can an employer monitor employee emails and internet usage in Colorado?

A: Well, it depends. Employers generally have more ability to monitor activity on company-owned devices, networks, and accounts, especially when the monitoring relates to legitimate business purposes.

However, Colorado law restricts employers from accessing an employee's personal social media accounts or personal electronic communications. For example, Colorado's Social Media and the Workplace law generally prohibits employers from requiring employees to provide passwords or access information for personal accounts.

Employers should also have clear policies explaining what workplace technology and communications they may monitor and how they may use that information.

Bottom line: A company email address or a company computer doesn't necessarily give an employer unlimited access to an employee's personal accounts or communications.
