Our client, a restaurant worker, came to us after being unlawfully terminated. While speaking with her, we discovered she had been working over 40 hours a week as both a cook and server, without receiving proper overtime pay.

To hide the overtime, her employer put her waitress hours on official payroll with paystubs, but paid her cooking hours off-the-books via Zelle. On top of that, they deducted pay for breaks she never took.

When she developed a health condition, management ignored her requests for sick leave and disability assistance, then unfairly terminated her.

We stepped in and recovered $40,000 for unpaid wages and illegal retaliation.

Can you be prohibited from discussing your salary in Colorado? 💰
Generally, NO.

Colorado law protects pay transparency and prohibits employers from taking certain actions to prevent employees from asking about, discussing, or disclosing information related to their salaries.

For example, your employer generally cannot establish a rule that says:
“You cannot talk to your coworkers about how much you earn.”

Nor can your employer retaliate against an employee for exercising protected rights related to pay transparency.

So if your employer tells you that you cannot discuss your salary, that could be a 🚩.

How many hours can an employee legally work in Colorado? 👀

The answer might surprise you:

There is no general maximum number of weekly hours that an adult worker can work.

In other words, 40 hours per week is NOT a limit. An employee can work more than 40 hours in a week.

Colorado does have special overtime rules: for covered employees, time and a half must generally be paid when they work more than:

• 40 hours in a workweek
• 12 hours in a workday, or
• 12 consecutive hours

But those rules determine when overtime applies; they do not set an absolute maximum number of hours you can work.

An employee was unlawfully terminated after requesting a reasonable accommodation in the form of a flexible schedule to coordinate care for their disabled child.

The company rejected his request for accommodation without evaluating alternatives, undermined his approved family leave by forcing him to work during that time, and took away his main projects.

To try to cover their tracks, management imposed an unjustified performance improvement plan on him with the sole intention of forcing him to resign before ultimately firing him unlawfully, but we intervened immediately to assert his rights and succeeded in recovering $62,500 in compensation for the retaliation he suffered. 💼🏛️✨
