Yesterday the Appellate Division, Third Department affirmed our successful December 2021 trial verdict in all respects. The case involved a motorcycle accident occurring on County Road 25 in Chenango County. Our client hit a series of dangerous ruts in a deteriorating road, causing him to be jettisoned from his motorcycle. He suffered a traumatic brain injury resulting in the permanent loss of hearing in his left ear, and a severely fractured ankle. In addition to affirming our verdict, the Court also reinstated post verdict interest at 9%. I am extremely proud of our firm's hard work, dedication, and perseverance in obtaining this excellent result for our client. Here is a link to the decision:

Earlier this week a jury awarded our client $1,173,000.00 in compensatory damages after finding that the County of Chenango negligently allowed a known hazardous condition to exist on County Road 25 near the Chobani plant. Our client instantly lost control of his motorcycle when he hit this dangerous condition, and suffered a severe head injury which rendered him permanently deaf in one ear, fractured his shoulder blade and tore several ligaments in his ankle, which required two surgeries. No comparative fault was assigned to our client by the jury. Andy Kirby represented our client during the six day trial. Peter McDaniel, Dana Wolin and Barbara Ippolito provided exceptional support getting this case ready for trial. We are extremely happy for our client, who never lost faith that a good and just outcome could be achieved.

Congratulations to attorney Liz Graziane's impressive Court of Claims victory today. Liz represents the estate of a 24 year old woman who tragically died on a snow covered portion State Route 9 in upstate New York. Her car struck an accumulation of wind-blown snow in her lane of travel, forcing her into the other lane and hitting another vehicle. As she does in each of her cases, Liz fought tirelessly on behalf of the estate, pursuing discovery, winning an appeal and then proceeding to a lengthy trial which included numerous witnesses and expert witnesses. In his 74-page decision, the Judge ruled that New York State failed to a) do an adequate study of the the road, b) follow its own manual, c) consider using passive snow control measures, and d) warn motorists of the dangers of drifting snow in the area. The Judge found that New York State was 95% at fault and that the decedent was only minimally responsible. Liz will now proceed with a trial on damages. Way to go Liz!

Conway & Kirby update on Covid-19

Yesterday, after a two week trial led by Andy Kirby, an Ulster County jury found in our client's favor, finding that her doctor committed malpractice. The jury awarded our client a substantial amount for her past and future pain and suffering, as well as her medical bills. Throughout the trial, attorneys Liz Graziane and Sara Bentley provided Andy with outstanding and invaluable support. We are very pleased that justice was done in this case!
