Recently visited Berkshire County, Massachusetts and found a cemetery with the graves of veterans and wives of veterans of the Revolutionary War. This country is still so young compared to the old world from where many of us came. Happy 4th.

Major property insurance “reforms” were passed last year, making it harder for homeowners to sue their insurance companies and easier for insurers to deny claims. We were told this had to be done to lower property insurance. Not surprisingly to the rest of us, insurers did not lower rates, and property insurance is set to rise up to 60% this year. Last month insurers were gifted with the same legal protections in auto, health and liability insurance. Again, we were told that this had to be done to lower our insurance costs ….

Today is the day that Florida lawmakers are scheduled to weaken more than a century of legal precedent meant to help insurance customers get fair settlements. The “Tort Reform” bill makes it harder for injury victims to recover the compensation they deserve from insurance companies. As of this morning, lawyers from all over the State of Florida have filed about 65,000 lawsuits to protect their clients’ rights under the existing legal framework. For perspective, there would usually be about 2,500 filed in the same time frame.

This is a bad bill that allows insurance companies to get a free pass to deny and under pay claims across all lines of insurance including health, auto, and life insurance. The Bill does not guarantee or require insurance companies to lower insurance premiums. The Bill benefits no one except large insurance companies and the People of Florida are getting nothing in return. Elections have consequences.

About 89% of those surveyed think insurance companies should remain responsible for all court costs if it’s determined the carriers wrongly denied coverage. Only 5% of voters wanted to eliminate one-way attorneys fees, a key part of proposals being heard now in the House and Senate.

As for a controversial proposal to eliminate a responsibility for apartment complexes to take appropriate measures to protect properties, 85% of respondents say landlords should be financially responsible for injuries or deaths resulting from lack of security, while just 8% disagreed. Florida lawmakers are not listening to Floridians - they are listening to their big donors.
