~ watching Life As We Know It. That moment when the parents die in a car accident and they leave behind a young child...reminds me (as if I need the reminder in my profession) how important it is to have documents in place to make sure your kids are protected. Leaving it up to the Court will mean delay, stress and uncertainty. Heartbreaking. Do the uncomfortable stuff now on behalf of your family...they will benefit, I promise.

FYI - in Florida if you want a non-resident to be Personal Representative of your Will - that person needs to fit in one of the following categories:

1. your legally adopted child (18 or older) or the parent who legally adopted you;

2. someone related to you by lineal consanguinity;

3. a spouse or a brother, sister, uncle, aunt, nephew or niece or someone related by lineal consanguinity; or

4. the spouse of someone otherwise qualified under Florida Statute Section 733.304.

So, for example, your wife's brother who lives out of state cannot be your PR. Neither can your wife's nephew who lives out of state.

This is another good reason to consult with an attorney even if you only need a simple estate plan. Downloading documents off of the internet may not provide you with the guidance you need to prevent your family from having to spend extra money in court to fix the problem when you are gone.
