If a business misled you, breached a warranty, or engaged in deceptive practices, you may have powerful rights under the Texas Deceptive Trade Practices Act (DTPA). Under Texas law, a consumer is anyone who seeks or acquires goods or services by purchase or lease, including personal and real property, and those goods or services must form the basis of the complaint.

This means individuals, families, and businesses can qualify as consumers if they bought or paid for a deceptive product or service.

The DTPA protects consumers from false, misleading, and deceptive acts, unconscionable conduct, and warranty violations. If you qualify as a consumer and the business’s conduct caused you damages, you may be entitled to economic damages, additional damages in cases of knowing or intentional misconduct, and your attorney’s fees.
