Mahomes Bolden PC specializes in corporate, securities and public finance transactions. While the firm provides comprehensive legal services to individuals, investment banking firms, privately held companies, mun

icipalities, public and quasi-public agencies, national corporations, banks, and non-profit corporations on a broad range of complex transactional matters, in recent years public finance has become our core practice area. We are making it our business to be a premier public finance firm. Our firm was founded in 1998. We have been active in rendering bond opinions for government issuers and underwriters since 2002. Since that time, the firm has issued opinions in numerous public finance transactions and has grown to five lawyers and two support staff. All of our lawyers are part of the public finance section of the firm. Three of our lawyers devote almost all of their time to the public finance practice. Mahomes has practiced for over thirty years and Mr. Bolden has practiced for ten years. The leadership of our public finance section decides which attorney will lead a particular public finance transaction and ensures that the firm’s resources are adequately and appropriately utilized for the transaction.

Congratulations to the Interdenominational Ministerial Alliance for their 54th Annual Dr C A W Clark Human Relations Banquet and to the Human Relations Award honoree Bill Mahomes. Thank you to Texas A&M Chancellor John Sharp for being there to introduce Mr. Mahomes. Those in attendance probably took notice to the pronunciation of “Mahomes” by Chancellor Sharp. Not too long ago “Mahomes” was pronounced /May - Homez/, but thanks to the phenomenal quarterback of the Kansas City Chiefs, Patrick Mahomes, the pronunciation has conformed to what you hear on TV as Patrick keeps setting the league on fire 🔥(Patrick is Bill’s nephew).

In any event, congratulations to the IMA, Bill Mahomes and to all of last nights awardees. I’m pretty sure we were at church last night 😊, but I will still do my best to attend Sunday service.

What type of negotiator are you?

There are basically two types of negotiators--competitive/bully and cooperative.

💪🏾 Competitive negotiators use hardball tactics such as ultimatums, walkouts, fist pounding, self serving comments, gratuitous insults and the like to further their negotiating objectives.

✌🏾Cooperative negotiators use compromise, splitting the baby and concepts to the bring the parties together to achieve their negotiating objectives.

Both negotiating styles can be effective, but is one more effective than the other? What do you think 💭?

Truly enjoy teaching negotiation at Baylor Law School for the Business Law Bootcamp. My co-adjunct professor and I taught a 3 hour course on the strategies deployed in negotiation that covered the following topics:

* Bargaining Styles of Negotiators
* Inclinations During Negotiation
* Four Key Habits of Successful Negotiators
* Stages of Negotiation
* Negotiation Tactics

Being aware of your own personal inclinations is one of the first steps to becoming a great negotiator.

If you are meeting with a prospective investor or potential business partner and you may be disclosing proprietary information (info you don't want your competitors to know) concerning your business or business concept, you absolutely should consider having the recipient of the information sign a non-disclosure agreement (NDA).

For example, you have a great business idea that needs funding and you want to seek funding from an investor, in order for the investor to decide whether or not they should invest, you will need to explain to them your business concept. Your fear will likely be that instead of investing, they steal your business concept and profit from it.

You will want an NDA to be executed.

Depending on the negotiating power of the two parties (example: a small entrepreneur introducing his idea/concept to Google will not have as much negotiation power or "leverage" as Google) the small entrepreneur may have to use the larger company's form of NDA or they may refuse to sign an NDA.

NDAs should be drafted carefully to adequately protect your interests and intellectual property and if a party refuses to enter into an NDA, you should carefully analyze the risk/reward of divulging proprietary information to the party.
