Have you received a foreclosure notice?

Selling the property before the foreclosure process is completed may be an option in some cases.

Depending on the amount of equity in the property and market conditions, a sale may allow the homeowner to satisfy the mortgage debt and potentially preserve remaining equity.

If you need legal help, the Lonergan Law Firm PLLC would be glad to speak with you. Call us at 214-503-7509 to schedule a consultation.

If you have received a foreclosure notice or are concerned about falling behind on mortgage payments, understanding your options early may be important.

In some situations, a lender may permit a homeowner to catch up on missed payments through a repayment plan.

Under this arrangement, the homeowner continues making regular mortgage payments while paying an additional amount toward the delinquent balance over time.

If you have questions about foreclosures, the Lonergan Law Firm PLLC would be glad to help. Call us at 214-503-7509 to schedule a consultation.

Recent reports indicate that foreclosure activity in North Texas has reached its highest level in several years. If you have received a foreclosure notice or are concerned about falling behind on mortgage payments, understanding your options early may be important.

Loan modification or other alternatives from the lender is a possibility that may be available.

Banks make money by lending money, so this may be a good option.

Depending on the lender's requirements and the homeowner's circumstances, a loan modification may be available. A loan modification typically involves changing one or more terms of the existing loan, such as the interest rate, repayment period, or treatment of past due amounts.

In addition, lenders often have departments dedicated to reviewing hardship situations and discussing possible alternatives to foreclosure.

The earlier those discussions begin, the more opportunities may be available for consideration.

The Clock Nobody Told You About

Excess proceeds from a Texas tax sale do not sit there forever waiting to be claimed.

There is a deadline. Once it passes, the funds are gone for good, no matter how legitimate the claim would have been.

Many people do not learn about the deadline until it has already passed. By then, there is nothing left to do.

Knowing the timeline early is the only way to protect a claim before it disappears.

Are you dealing with a probate or heirship situation? Do not assume it will go smoothly.

Title issues are extremely common in probate and heirship situations.

Unpaid debts of the deceased, Medicaid claims under the Estate Recovery Program, unknown heirs, and prior unprobated estates are the kinds of complications that can slow or stop a deal entirely.

What kinds of title issues have you encountered in these kinds of situations?

When a property is sold at foreclosure auction for more than what was owed, what happens to the money that is left over? In Texas, the former owner of record, or that owner's heirs, may be entitled to claim that money. It sounds simple but rarely is.

When a property is sold at foreclosure auction for more than what was owed, the money left over is called excess proceeds, sometimes referred to as surplus funds. In Texas, the former owner of record, or that owner's heirs, may be entitled to claim that money.
