Texas does not require you to retreat before using force in self-defense, but that doesn’t mean anything goes.

To claim self-defense without a duty to retreat, you must:

✅ Be lawfully present
✅ Not have provoked the situation
✅ Not be engaged in criminal activity

Even then, your actions must still be reasonable under the circumstances. In serious cases, especially those involving injury or death, law enforcement and prosecutors will closely examine both whether force was justified and how much force was used.

Self-defense cases are highly fact-specific, and small details can significantly impact how a case is charged and defended.
