Let's talk child support. 💰

In Texas, child support is based on a percentage taken from the obligor's (aka, the parent paying child support) net income from all sources. For example, if the child support case only involves one child, and the obligor does not have any other children under the age of 18 or otherwise supporting, the obligor's monthly child support payment will equal 20% of their net income.

However, if the case involves one child but the obligor is already paying child support for another child (from a prior marriage, etc.), the obligor's child support payments will drop down to 17.50%.

If the obligor has $1k or less in monthly net resources, a lower percentage of child support will be withheld across the board -- these amounts are not reflected in this chart.

While pets are technically considered property under Texas law, courts increasingly acknowledge the emotional bond between pets and their owners. In family law cases like divorce, pets may be a central point of dispute, with many clients seeking what’s best for their furry family members.

Texas courts may consider factors like who primarily cared for the pet, each party’s relationship with the pet, and the pet’s well-being when making decisions. Though pets aren't treated like children in legal terms, they’re often an integral part of the family dynamic.

In fact, if you are seeking a protective order, the court may prohibit the other party from removing a pet, companion animal, or assistance animal from your possession -- see Texas Family Code 85.021(1)(c).

In Texas, when it comes to child custody, the best interest of the child is always the court’s top priority. The Holley Factors are key guidelines that help judges make decisions based on what’s best for the child—now and in the future. Here’s a breakdown of these important factors:

1️⃣ The Child’s Wishes – If the child is old enough and mature enough, their preference may be considered.
2️⃣ Emotional & Physical Needs – What does the child need emotionally and physically, both now and later?
3️⃣ Safety & Danger – Is the child in danger? The court will assess both current and potential risks to the child’s safety.
4️⃣ Parental Abilities – Do the parents have the necessary skills and stability to meet the child’s needs?
5️⃣ Programs & Support – Are there any services or programs available to help the parents provide a better environment for the child?
6️⃣ Plans for the Child – Are the parents’ long-term plans stable and focused on the child’s best interests?
7️⃣ Home Stability – How stable and consistent is the living environment? Stability is key for a child’s emotional development.
8️⃣ Parental Conduct – The behavior of each parent, including past actions or omissions and any excuses for them, is considered to determine the health of the parent-child relationship.

⚖️ Important to know: While these factors are crucial, courts have discretion to consider other elements of the case too—always with the goal of determining what’s best for the child. 🙌
