You cannot send or receive electronic messages while driving in Texas. Even if you are stopped at a red light and not moving this applies to you. So that means no emailing and no texting. It is an affirmative defense if you are reporting illegal activity, summon emergency help or entering information into a software application that provides information relating to traffic and road conditions to users of the application. Starting in 2025 the fine for a first offense is $200, second offense $400 and third offense is mandatory court appearance and potential community service. An individual with a commercial driver’s license is held to a higher standard even if the person is driving their personal vehicle. The courts are not allowed to grant CDL drivers either deferred disposition with a possible exception for nonmoving violations or defensive driving. While some persons may be eligible for deferred adjudication for a DWI case, commercial drivers are ineligible. CDL holders need experienced attorneys. A trial may be the only means the CDL driver has to try to win their case for criminal cases involving traffic tickets and driving while intoxicated cases.

Vehicle Safety Inspections are no longer required for vehicle registration. You must still get the registration taken care of or else you may receive a traffic ticket. Emissions testing may still be required by local ordinances for vehicles in densely populated counties like Dallas County. Check your county's website to determine if the emissions testing is required by your county as a condition of obtaining your registration. Registration fees will go up to compensate the State for the loss of revenue.

Do not pay the fine for class c assault cases and theft cases in the municipal courts if you are not a US citizen. You should contact our firm for assistance with these cases. Deferred disposition may be the only option but this option is considered to be a conviction by the federal government for immigration purposes. Most municipal courts will not offer conditional dismissals but at least one court does. Sometimes deferred disposition is the only option but sometimes the best route is a jury trial. We have been handling cases in Dallas County Justice courts. Goal is always to keep the traffic ticket off our client’s driving record and to keep insurance rates down. We post appearance bonds where required to lift warrants and advise our clients to pay OMNI fees to lift holds on their driver’s license. We set cases for trial if client wants to come to court to see if police officer appears on the trial date. Sometimes police officer show and we either negotiate with the State to obtain deferred disposition or even sometimes dismissals. If needed or the clients wants to fight the ticket we take the case to trial. If the police officer fails to appear we ask for dismissal.
