Chris joins Sbaiti & Company’s Mass Tort and Class Action groups, where he will continue his work representing clients in complex product liability and other high-stakes litigation matters. He brings extensive experience handling cases in federal and state courts, including multidistrict litigations and other consolidated proceedings involving complex legal issues and sophisticated corporate defendants.

Sbaiti & Company PLLC has filed a lawsuit (1:26-cv-06326) in the U.S. District Court for the District of New Jersey on behalf of our client against Abbott Laboratories concerning alleged manufacturing defects in its Proclaim XR spinal cord stimulator.

The complaint alleges that the Proclaim XR spinal cord stimulator contained defects in its Bluetooth circuit components that caused excessive battery drain, overheating, and painful, uncontrolled electrical shocks. It further alleges that Abbott was aware that these issues stemmed from manufacturing defects dating back to at least 2018, but Abbott mischaracterized the problem as software-related and attempted to address it through software updates rather than correcting the underlying hardware failure. The complaint also alleges that Abbott continued to sell the device despite ongoing reports of serious adverse events by patients and did not fully and accurately disclose the defect in its labeling, marketing, and regulatory reporting.

“Patients trust that implanted medical devices have been manufactured in accordance with regulatory requirements and are safe for their intended use,” said Christopher L. Ayers, Co-Chair of the Firm’s Mass Tort Practice Group and Chair of the Consumer Protection Practice Group at Sbaiti & Company PLLC. “This lawsuit seeks to hold Abbott accountable for alleged failures that exposed patients to unnecessary harm.”

A New Jersey man said in a suit filed in Garden State federal court on Friday that Abbott Laboratories' spinal cord stimulator system was manufactured with defects that were never truly resolved because of Abbott's mischaracterization of the issue, which caused him painful electric shocks.
