Last week I was in a jury trial all week in Collin County on a Capital Murder case (non-death penalty case). The case was a "cold case" from 2009 that the police had only recently started investigating again but who did not really understand how the offense actually occurred. My client was a gullible person who believed that if he explained what happened to the police and took responsibility he would not be charged and possibly used as a witness against others as the police had told him on audiotape. This statement was taken from my client by the Texas Rangers before he was actually charged with a crime and he could have canceled the interview at anytime.

The police clearly told him repeatedly, "we want to use you as a witness and we have connections with the Governor and we can make things happen!" Despite playing the audiotape statement to the Court and to the jury and objecting to the admission of the audiotape statement, the audio statement was considered "voluntary" and not coerced. The Defendant was thereafter convicted of Capital Murder and given a life sentence which is automatic in Capital Murder cases.

The moral of the story is when the police tell you that "you have the right to have a lawyer present during any questioning", and/or especially if you're not sure, please exercise your legal right to counsel and stop talking please!!!!!!
