Carrying a Handgun by a Licensed holder in a Motor Vehicle
The Texas Legislature past several bills during this last session that were signed into law by our governor among these is H.B. 1407 Titled “Carrying a Handgun by a Licensed Holder in a Motor Vehicle” that became effective on September 1, 2021.

Under the law before enactment of H.B. 1407 individuals with a license to carry a handgun were permitted to carry a handgun on their person when in a motor vehicle but were subject to prosecution if the handgun was visible in the motor vehicle, but not on their person. H.B. 1407 amends Sec. 46.035 of the Penal Code, expanding the exception to the offense of Unlawful Carry by a License Holder if the handgun was in a holster and the license holder was in a vehicle.

Along with the above, the Legislature past many additional bills that were signed into law regulating carrying a handgun, licensed or unlicensed. Be sure to familiarize yourself with all the laws pertaining to handguns or failing to understand and obey them can land a person in serious criminal trouble.

Special Hunting Permits for Veterans & Active-Duty members of Military
For Veterans & active-duty members of the Military who enjoy hunting the Texas legislature has expanded our opportunity. S.B. 675 effective last May 30, 2021, amends chapter 62 of the Parks and Wildlife Code to authorize the Commission to provide for special open seasons during which the taking and possession of certain migratory game birds is restricted to veterans and active-duty members of the U.S. armed forces. The bill also sets out provisions relating to the proof of veteran or active-duty status required to participate in the special open season. This brings state hunting laws in accordance with federal hunting laws.
To qualify for a license, one must contact the Parks and Wildlife Commission of Texas to learn what is needed to qualify for a license and to enjoy this special open season for Veterans and active-duty members of the U.S. Armed Forces.

A new law has been passed known as H.B. 1306 and now is in effect. This Law increases the Penalty for Assault and Aggravated Assault of a Process Server beginning September 1, 2021. It makes several changes to Chapter 22 of the Penal Code. The amended Sec. 22.01 (Assault) adds a definition for the term “process server” and increases the punishment from a Class A misdemeanor to a felony of the third degree for assault committed against a person the actor knows is a process server while the person is performing a duty as a process server. When you are told he/she is a process server, you will know who you are dealing with.
