Senior Partner Anthony LaScalea was invited to attend the Aon Transportation & Logistics Symposium at the Omni PGA Frisco Resort in Frisco, Texas.

Over two days, industry leaders in the transportation and logistics sector came together to discuss evolving market trends, risk management strategies, insurance outlook, and government affairs updates impacting the industry. The program also featured CEO insights on the challenges and opportunities shaping the industry’s future.

The event concluded with a message from Ian Baker-Finch, former PGA Champion and sports commentator, whose perspective on performance, resilience, and mindset provided a strong close to the symposium, followed by a reception on the course.

Following a fatal traffic accident involving a commercial vehicle, the Plaintiff filed suit against our client, Home Depot, alleging a common shipper of goods has a duty under Texas law to vet, control, or be responsible for the independent acts of a motor carrier and its driver. The dismissal of the case was initially denied by the Trial Court and again by the 14th Court of Appeals. The Texas Supreme Court granted a mandamus, holding today that a shipper has no such duties and ordered that all claims against Home Depot be dismissed as a matter of law.

In a case of first impression, Equity Partner Daniel Karp, with the assistance of Mike Eady, convinced the Texas Supreme Court that placing a burden on a common shipper would not only be new law but would contradict many of the guiding principles of tort responsibility in Texas.

This well-thought-out decision marks a win not only for our client, but also for consumers across our great state who depend on shippers like Home Depot to keep our shelves stocked.

The Fee, Smith & Sharp trial team of Thomas Fee, Craig Myers, and Ashley Snell Smith obtained a take-nothing defense verdict in the case styled Robert Murphy v. Keandre Davis and Ben E. Keith Co., Cause No. DC-23-17608, pending in the 134th Judicial District Court of Dallas County.

The plaintiff alleged that he suffered a severe traumatic brain injury as a result of a collision between a vehicle driven by an employee of Ben E. Keith and the plaintiff. After a week-long trial, the jury determined that the plaintiff was 90% responsible for his own injuries, meaning the defendants owed nothing.

The plaintiff never made a firm demand below $40 million, although a proposed “bracket settlement” of $30 million / $10 million was discussed shortly before trial.
