Is my bankruptcy trustee an opp? ๐
Not exactly.
But your Chapter 7 trustee is also not your attorney and is not there to protect your interests.
The trustee has an independent job: reviewing your assets, exemptions, income, transfers, and financial history to determine whether there is property that can be sold off for the benefit of your creditors.
That is part of why Chapter 7 is sometimes called a liquidation bankruptcy.
Does that mean the trustee automatically takes everything you own? No.
A major part of Chapter 7 planning is determining which assets are protected by bankruptcy exemptions and whether there is anything the trustee could potentially liquidate.
That is why I spend so much time reviewing assets before a case gets filed.
Iโm Adrian Spearman, a Texas Chapter 7 bankruptcy attorney serving clients statewide.
