Something that stops divorced fathers cold when I describe it: the person most likely to be with their children in a crisis, whether a new partner, a trusted family member, or a close friend, may have no legal authority to help them.

Not because that person would not step up. Because no document exists that says they can. Without it, they cannot authorize medical care. They cannot make decisions on behalf of the children. In the eyes of the hospital, they are a legal stranger, regardless of how present they have been in the children's lives.

For divorced fathers, especially, the person who would naturally step in at the worst moment is often not a legal parent. I make sure the gap is closed before anything happens, with the right plan in place.

Did you know? A stepparent has no automatic authority to make medical decisions for a stepchild — not even if they have been the child's primary caregiver for years.

In an emergency, without a specific legal document in place, you are a legal stranger. The hospital has no obligation to consult you. A biological relative who shows up may have more standing than you do, regardless of how many years you have been their parent.

The document that changes this is straightforward. But it has to exist before the emergency, not after. Once you are already in the waiting room, it is too late.

One of the questions that came up during this week’s estate planning presentation was whether life insurance pays out immediately after someone dies.

The answer is: not usually.

Life insurance often avoids probate and is frequently one of the fastest assets available to a family after a loss. However, beneficiaries still need to file a claim, provide a death certificate, and complete the insurance company’s process before benefits are paid.

This distinction matters because families often assume money will be available instantly when, in reality, there can still be a waiting period.

One of the biggest estate planning myths is this:

“If I have a Power of Attorney, my family can handle everything.”

Unfortunately, that’s not always true.

I’ve seen families do everything right. They have a valid Power of Attorney. They know exactly what their loved one wanted. They’re simply trying to pay bills and keep things running during a medical crisis.

And then the bank says no.

Not because the document is invalid.

Not because the family did anything wrong.

But because the document was never reviewed by the bank, the institution has its own requirements, or the process wasn’t set up before the emergency happened.

Meanwhile, life doesn’t stop.

〰️ Mortgage payments are still due
〰️ Utility bills still need to be paid
〰️ Care decisions still need to be made
〰️ Families are left trying to solve problems while worrying about someone they love

Today I’m not posting as an attorney.

I’m posting as a Marine momma. 🇺🇸

And on this Memorial Day, I need to say what’s on my heart.

Memorial Day isn’t a holiday to me. It’s a holy day.

It’s the day I look at my son, my Marine, and I am reminded that there are mothers just like me who sent their child off… and waited… and that knock on the door came instead. 😞

I will never take for granted what that means.

Every boot left at a memorial. Every folded flag handed to trembling hands. Every name etched in stone that used to have a heartbeat, a laugh, a mama who called them by a nickname only she used.

Freedom was not free. It was purchased with someone’s child.

And some families are still paying that price today. 💔

So now that the cookouts are done and long weekend is coming to a close I invite you to pause. Just pause.

Say a name. Light a candle. Hug your people tighter.
