A lot of people ask questions about EVADING ARREST: here is a little information and feel free to call if you have any questions.

EVADING ARREST:

Generally my first question is why did you stop? Then after hearing facts I usually ask- “Why did you NOT stop, you probably would have only received a ticket?”

A few responses I have heard are “When at cruising speeds for us on high powered machines we freak out and drop a gear to disappear.” If you find yourself in this unfortunate circumstance those lights caught you. 1st stop talking, then remember call the one who understands this situation more than any other attorney.

When you use a quality attorney like me we actually request a copy of all video and audio tapes and review them. Many times the quality is bad and not good enough to identify the person or bike. Now if you told your location during questioning you just identified yourself.

With my experience of reviewing numerous videos you need to make it difficult for them to prove the case and you have a good chance of a lesser charge or dismissal.

I have had cases where the arrested did not know they were being chased, just speeding and the cop thought they were in pursuit, especially when riding with no mirrors.

When you do get stop - the number one rule is to stop talking, it only makes things worse. Keep quiet and provide your identification. Be polite but don’t give addition information like where you were coming from or who you were riding with. If you acknowledge the people or location then you just placed yourself in the potential group they were looking for. Just stop talking.

Again stop talking the entire time while in custody. Remember you are being recored in the car on the way to jail and even when you are outside the car and potentially in the jail. When they are in the car and you are at your vehicle don’t talk because you could be getting recorded.

Everything you say will be used against you. Police don’t have to be truthful to you. They can say “come on just tell me you were the person I was chasing and I will let you go”. Don’t admit anything it is a trap. They will question you until they read you the Miranda rights and even after that. If you choose to answer questions that is your choice but not a good one.
