Not a bad Article overall, not quite the full story though. Whether or not specific asset details are included in the Will, the details are all shown on the Inventory in Probate. Also disinheriting an heir in the Will does not preclude their right to challenge the Will. Concerns like these are some of the reasons that we, as practitioners see more and more Trusts being done these days. If you speak with an estate planner and they don’t review trust options as well, you owe it to yourself and your family to at least get informed to ensure the right tools are being used for you.

The start of a new year brings a fresh perspective — making it the perfect time to revisit your power of attorney (POA).

As a reminder, a POA is a legal document that allows someone you trust to make financial decisions on your behalf. Not only does it ensure that when you need a helping hand, someone else can actually assist, it also keeps the Court out. When a POA is not in place or not done correctly we often are stuck pursuing a guardianship case. These are expensive, cumbersome, and strip your rights away. With a POA, you choose who can step in and assist, when they can help, and you retain your autonomy. In some state, like Ohio, there is no legal requirement that a POA be honored. As such, it's critical to have thorough updated documents to comply with the requirements of your local institutions.

If your life changed in 2025, whether from marriage, divorce, new family members, or health shifts, you should think about revisiting who you want to handle important matters if you’re unable to.

Help make a difference this winter! Six local communities—Stow, Cuyahoga Falls, Munroe Falls, Silver Lake, Hudson, and Tallmadge—are teaming up to collect warm winter clothing for those in need.
