미국 퍼블릭 차지 (Public Charge, 공적부조) 규정 변경 안내
시행일: 2026년 9월 18일

미국 국토안보부(DHS)는 2026년 7월 20일 새로운 퍼블릭 차지(Public Charge) 규정을 발표했습니다.

이번 규정은 영주권이나 미국 입국 심사 시, 정부가 신청인의 경제적 자립 가능성을 이전보다 폭넓게 심사할 수 있도록 변경한 것입니다. 다만, 정부 혜택을 받았다는 이유만으로 영주권이나 비자가 거절되는 것은 아닙니다. USCIS는 신청인의 소득, 재산, 건강, 직업, 교육, 가족 상황 등 여러 요소를 종합적으로 검토하여 판단합니다.

누가 영향을 받을까요?

주로 다음과 같은 분들이 해당됩니다.
• 미국 내에서 영주권(Adjustment of Status)을 신청하는 경우
• 미국 입국 심사를 받는 경우

미국 대사관이나 영사관에서 비자를 신청하는 경우에는 국무부(Department of State)의 별도 퍼블릭 차지 기준이 적용됩니다.

다음과 같은 경우에는 일반적으로 퍼블릭 차지 규정이 적용되지 않습니다.
• 미국 시민권자
• 난민(Refugee)
• 망명자(Asylee)
• VAWA 신청자
• T/U 비자 신청자
• SIJ(특별이민청소년) 등 법에서 면제하는 이민 카테고리

어떤 사항을 심사하나요?

USCIS는 다음과 같은 사항을 종합적으로 고려합니다.
• 나이 및 건강상태
• 소득 및 재산
• 직업 및 향후 취업 가능성
• 학력과 경력
• 가족 구성
• 건강보험 가입 여부
• 필요한 경우 재정보증서(Form I-864)
어느 한 가지 요소만으로 영주권이 결정되지는 않습니다.

어떤 정부 혜택이 문제가 될 수 있나요?

정답은 하나가 아닙니다. 다만, 영주권 신청인 본인이 소득이나 재산 기준에 따라 제공되는 정부 복지 혜택을 새로 신청하거나 갱신하려는 경우에는, 해당 혜택이 퍼블릭 차지 심사에 영향을 줄 수 있는지 먼저 확인하시기 바랍니다.

대표적인 예는 다음과 같습니다.
• SSI
• TANF
• Medicaid
• SNAP(Food Stamps)
• 공공주택(Public Housing)
• Section 8
• 정부 렌트 보조
• 기타 저소득층 대상 의료, 식품, 주거, 생활비 지원 프로그램

연방정부 프로그램뿐 아니라 주정부 및 지방정부 프로그램도 동일하게 검토 대상이 될 수 있습니다.

일반적으로 문제가 되지 않는 혜택

다음과 같이 근로를 통해 취득했거나, 소득 수준과 관계없이 받을 수 있는 혜택은 일반적으로 퍼블릭 차지 대상이 아닙니다.
• Social Security 연금
• SSDI(근로 이력에 따른 장애연금)
• Medicare
• 실업수당(Unemployment Insurance)
• 산재보험(Workers’ Compensation)
• 공무원연금 등 각종 연금
• Veterans Benefits
• 회사 건강보험
• 개인 건강보험
• 교회나 자선단체의 지원
• 장학금
• 상환해야 하는 대출

다만 일부 Medicare 관련 저소득 보조 프로그램 등은 별도로 검토가 필요할 수 있습니다.

자녀가 받는 혜택은 어떻게 되나요?

미국 시민권자인 자녀가 Medicaid, 학교 급식, SNAP 등의 혜택을 받더라도 원칙적으로 부모가 그 혜택을 받은 것으로 간주되지는 않습니다.
따라서 자녀가 필요한 의료보험이나 복지 혜택을 받고 있다는 이유만으로 급하게 중단하실 필요는 없습니다.

다만 USCIS는 가정 전체의 경제 상황을 함께 검토할 수 있으므로, 신청인의 재정 상태는 여전히 심사 대상이 될 수 있습니다.

2026년 9월 18일 이전에 받은 혜택은 어떻게 되나요?

대부분의 비현금성 정부 혜택은 2026년 9월 18일 이전에 받은 경우 기존 규정에 따라 심사됩니다.

반면, 2026년 9월 18일 이후 신청하거나 승인받거나 실제로 받은 혜택은 새로운 규정에 따라 검토될 수 있습니다.

영주권을 곧 신청할 예정이라면?

이미 영주권 신청 자격이 갖추어져 있고 서류 준비가 완료된 경우에는 2026년 9월 18일 이전에 신청하는 것이 유리할 수 있습니다. 다만 단순히 시행일 전에 접수하기 위해 미비한 서류를 제출하는 것은 권장하지 않습니다.

또한 USCIS는 새로운 규정에 맞춰 Form I-485를 개정할 예정이므로, 접수 직전에 반드시 최신 양식을 확인해야 합니다.

어떻게 해야 하나요?

다음과 같은 혜택만 받고 계신다면 일반적으로 문제 대상이 아닙니다.
• Social Security 연금
• SSDI
• Medicare
• 실업수당
• 산재보험
• Veterans Benefits
• 회사 건강보험
• 개인 건강보험
• 교회나 자선단체의 지원

반면, 영주권 신청인이 본인 명의로 저소득 또는 재정적 필요를 기준으로 제공되는 정부 복지 혜택을 새로 신청하거나 갱신하려는 경우에는, 먼저 이민전문 변호사와 상담하시기 바랍니다.

또한 혜택 승인서, 갱신서, 종료 통지서 등을 잘 보관하시기 바랍니다.

이번 규정은 “이 혜택은 받아도 되고, 저 혜택은 절대 안 된다”는 식으로 단순하게 설명할 수 있는 제도가 아닙니다.

New Public Charge Rule: Public Benefits and Immigration Applications
Effective September 18, 2026

On July 20, 2026, the Department of Homeland Security published a final rule removing the 2022 public charge regulation.
Beginning September 18, 2026, immigration officers will have broader discretion to consider an applicant’s finances, health, employment, and use of certain public benefits when deciding adjustment-of-status and admission applications. Using a public benefit does not automatically result in denial. USCIS must review the applicant’s overall circumstances.

Who May Be Affected?

The public charge rule primarily affects people who are:
• Applying for adjustment of status, commonly called a green card application; or
• Seeking admission to the United States.

Visa applicants applying through a U.S. consulate are subject to separate Department of State public charge procedures.

The public charge rule does not apply to U.S. citizens. It also does not apply to many humanitarian categories, including refugees, asylees, VAWA self-petitioners, certain T and U visa applicants, and Special Immigrant Juveniles.

What Will USCIS Consider?

USCIS may consider factors including:
• Age and health;
• Income, assets, and financial condition;
• Employment and employment prospects;
• Education, skills, and work history;
• Family size and financial obligations;
• Health insurance; and
• A required Form I-864 Affidavit of Support.
No single factor automatically determines the outcome.

Which Benefits May Be Considered?

There is no complete list of benefits that are always prohibited or always safe. As a general rule, an applicant should obtain immigration advice before personally applying for or renewing a federal, state, or local government benefit for which eligibility is based on low income, limited assets, or financial need.

Examples may include:
• SSI, TANF, or other cash welfare;
• Medicaid or other income-based health coverage;
• SNAP or food stamps;
• Public housing, Section 8, or rental assistance; and
• Other government-funded food, health, housing, utility, or financial assistance based on need.

The name of the program does not determine whether it is relevant. State and local programs may be considered in the same manner as federal programs.

Which Benefits Are Generally Lower Risk?

Benefits earned through employment or service, benefits not based on financial need, and private assistance generally should not be treated as means-tested public benefits.
Examples include:
• Social Security retirement benefits;
• Social Security Disability Insurance based on work history;
• Medicare based on employment contributions;
• Unemployment insurance;
• Workers’ compensation;
• Government pensions;
• Veterans’ benefits;
• Employer-provided or private health insurance;
• Private scholarships;
• Private charity, church, or food-bank assistance; and
• Loans that must be repaid.

Low-income subsidies connected to Medicare or another program may require separate review.

What About Benefits for Children?

Benefits received solely by a U.S. citizen child or another family member generally are not treated as benefits received by the immigration applicant.

For example, a child’s Medicaid, school meals, or food assistance generally is not considered the parent’s benefit when the child is the eligible recipient.

USCIS officers may still look at your overall household finances. If your child qualifies for benefits because the family income is low, that underlying financial picture can be considered as part of your overall financial circumstances.

What About Benefits Received Before September 18, 2026?

Most noncash benefits received entirely before September 18, 2026, will continue to be evaluated under the 2022 rule and will not become newly countable under the broader standard. However, public cash assistance for income maintenance and government-funded long-term institutional care may remain relevant under the prior rule.

Benefits applied for, approved, or received on or after September 18, 2026, may be reviewed under the new rule.

Should I File Before September 18, 2026?

Applicants who are already eligible and fully prepared to file may wish to discuss whether filing before September 18, 2026, is appropriate. Do not submit an incomplete or inaccurate application merely to file before the effective date.

USCIS is expected to revise Form I-485 and its instructions. Applicants should confirm the correct form edition immediately before filing.

What Should I Do?

Do not cancel necessary medical, food, or housing assistance without first considering the effect on your family.

In most cases, you do not need immigration advice solely because you receive Social Security retirement benefits, SSDI based on work history, Medicare, unemployment insurance, workers' compensation, veterans' benefits, an employment-based pension, employer-provided health insurance, or private charitable assistance.

However, before the immigration applicant personally applies for or renews a government benefit based on low income, limited assets, or financial need, the applicant should consult an immigration attorney.

Keep all benefit approval, renewal, and termination notices, along with documents identifying the recipient and the dates of assistance.

Important

There is no single list of benefits that every immigration applicant may safely use.
The effect of a benefit depends on:
• The applicant’s immigration category;
• Whether the applicant is subject to the public charge rule;
• Who received the benefit;
• Whether eligibility was based on financial need;
• When and how long the benefit was received; and
• The applicant’s overall financial circumstances.

F-1 “체류기간(D/S)” 제도 폐지
F-1 유학생이 꼭 알아야 할 실무 안내
최종 규칙 공표: 2026년 7월 17일 | 시행 예정일: 2026년 9월 15일

핵심 변화: 시행일 이후 F-1 학생은 원칙적으로 I-94에 “D/S”가 아니라 구체적인 체류 만료일을 받게 됩니다. 학교가 I-20를 연장해 주더라도, 그것만으로 미국 내 합법 체류기간이 자동 연장되지는 않습니다.

1. 비자, I-20, I-94는 각각 역할이 다릅니다
• 비자 스탬프: 미국 입국을 신청할 수 있게 해 주는 서류입니다. 미국에 들어온 뒤 얼마나 오래 체류할 수 있는지를 결정하지는 않습니다.
• Form I-20: 학교, 전공, 학위과정, 프로그램 시작일과 종료일을 기록합니다.
• Form I-94: 미국에 체류할 수 있는 기간의 최종 한도를 정합니다. 다만 I-94 만료일까지는 무엇을 해도 된다는 뜻은 아닙니다. 재학, 취업, 보고의무 등 F-1 조건을 계속 지켜야 합니다.
실무 팁: 미국에 다시 입국할 때마다 CBP 웹사이트에서 I-94를 내려받아 “Admit Until Date”를 확인하고, 휴대전화와 달력에 만료일을 저장하십시오.

2. 앞으로 얼마나 체류할 수 있습니까?
새 제도에서는 보통 I-20에 기재된 프로그램 기간만큼 입국이 허가되지만, 원칙적으로 최대 4년을 넘지 못합니다. 새 고정기간 체계로 입국하거나 체류연장을 받은 학생의 졸업 후 출국 준비기간은 기존 60일이 아니라 일반적으로 30일입니다. 어학연수 과정은 대체로 최대 24개월과 30일의 출국 준비기간이 적용됩니다. F-2 가족의 체류기간은 F-1 본인의 체류기간을 넘을 수 없습니다.

3. 현재 미국에서 D/S로 체류 중이라면
2026년 9월 15일 현재 F-1 신분을 정상적으로 유지하고 있다면, 시행일에 맞추어 새 I-94를 신청할 필요는 없습니다. 일반적으로 전환 체류기간은 다음 두 날짜 중 더 늦은 날까지 인정됩니다:
• 2026년 9월 15일 현재 유효한 I-20의 프로그램 종료일
• 유효한 EAD의 만료일
다만 최장 2026년 9월 15일부터 4년, 즉 2030년 9월 15일까지로 제한되며, 해당 전환 대상자는 기존 60일의 출국 준비기간을 유지합니다.

사례 - 현재 석사과정 학생: 미나는 D/S로 입국했고 계속 정상적으로 재학 중이며 I-20 종료일이 2027년 5월 20일입니다. 출국하지 않고 신분을 유지한다면, 보통 그 날짜까지 전환 체류가 인정되고 이후 60일의 출국 준비기간이 이어집니다. 규칙이 시행된다는 이유만으로 새 I-94를 받을 필요는 없습니다.

여행 주의: 2026년 9월 15일 이후 해외여행을 하면, 재입국 시 D/S가 아니라 특정 만료일이 적힌 I-94를 받을 가능성이 높습니다. 여행 전 DSO에게 SEVIS와 I-20를 확인하고, 과거 신분 문제나 USCIS 계류 사건이 있다면 반드시 변호사와 검토하십시오.

4. 졸업이나 학업 완료에 시간이 더 필요하다면
학교는 계속 I-20를 연장할 수 있지만, 학교의 I-20 연장만으로 I-94 만료일 이후 체류가 허용되지는 않습니다. 일반적으로 다음 절차가 필요합니다:
1. DSO로부터 체류연장을 추천하는 새 I-20를 받습니다.
2. I-94 만료 전에 USCIS에 Form I-539를 접수합니다.
3. 접수비와 증빙자료를 제출하고, USCIS가 요구하면 생체정보 절차를 진행합니다.
4. 질병, 연구방향의 불가피한 변경, 본인의 통제를 벗어난 중대한 학업 사유 등 정당한 지연사유를 입증합니다.
학사경고, 정학, 반복적인 수업 미이수 또는 통상적인 학업진척을 하지 못한 사정은 일반적으로 충분한 사유가 되기 어렵습니다.

연장 신청 결과에 따른 처리
I-539가 적시에 접수되어 심사 중: 일반적으로 심사 중에는 미국에 체류하며 풀타임 학업을 계속할 수 있습니다. 취업허가가 별도로 유지되는지 확인하십시오.

I-94 만료 후 I-539 거절: 거절 후 별도의 유예기간이 없습니다. 본인과 F-2 가족은 즉시 출국해야 합니다. 거절 후 체류하면 불법체류가 시작될 수 있습니다.

5. 전학, 전공 변경, 두 번째 학위가 크게 제한됩니다
• 학부 이하 학생은 원칙적으로 첫 학년 동안 전학, 전공 변경 또는 교육단계 변경을 할 수 없으며, 예외적으로 SEVP 승인이 필요한 경우가 있습니다.
• 대학원생은 원칙적으로 재학 중 교육목표를 변경할 수 없고, 예외적인 사정이 없는 한 학교를 옮기는 것도 제한됩니다.
• 2026년 9월 15일 이후 미국에서 F-1 학위과정을 마친 학생은 원칙적으로 같은 단계 또는 더 낮은 단계의 새 F-1 과정에 진학할 수 없습니다.

상위 단계로 진학하는 것은 가능합니다.

가능한 사례: 다니엘이 학사과정을 마친 뒤 석사과정에 진학하는 경우입니다. 학위단계가 올라가는 정상적인 진학입니다.

일반적으로 허용되지 않는 사례: 사라가 2026년 9월 15일 이후 미국 석사과정을 마친 뒤, CPT를 계속 활용하기 위해 다른 석사과정에 등록하려는 경우입니다. 같은 학위단계이므로 원칙적으로 F-1 신분을 유지할 수 없습니다.

CPT 자체가 폐지되는 것은 아닙니다. 8 C.F.R. §214.2(f)(10)(i)에 따른 CPT 제도는 유지되지만, I-94 체류기간을 넘겨 CPT를 계속할 수는 없습니다. 모든 CPT I-20, 고용제안서, 수강기록과 해당 훈련이 정규 교육과정의 일부였음을 보여주는 자료를 보관하십시오.

6. OPT 및 STEM OPT

D/S 전환규정의 보호를 받는 학생은 일반적으로 기존 60일의 졸업 후 출국 준비기간을 유지합니다. 반면 새 고정기간 체계로 입국하거나 연장된 학생은 일반적으로 30일만 인정됩니다. 최종 규칙은 일부 OPT 및 STEM OPT 신청에 한시적 전환 특례를 두고 있으나, 적용기한과 요건이 기술적이므로 대략적인 “6개월” 계산에 의존하지 말고 실제 접수 전 확인해야 합니다.

사례 - STEM OPT: 알렉스가 유효한 D/S 신분으로 STEM OPT 중이고 EAD가 2028년 6월 30일까지라면, 일반적으로 2026년 9월 15일 현재 I-20 종료일과 EAD 만료일 중 더 늦은 날까지 전환 체류기간이 인정됩니다. 다만 2030년 9월 15일이라는 최장 한도를 넘을 수 없습니다.

7. 가장 긴급한 문제: 이미 F-1 신분을 위반했을 가능성이 있는 학생
전환규정은 2026년 9월 15일 현재 F-1 신분을 정상적으로 유지하고 있는 학생에게만 적용됩니다. 과거의 무단취업, 사전승인 없는 학점미달, OPT 실업 허용일수 초과, 프로그램 종료 후 장기체류 등을 치유해 주지는 않습니다.

명시적인 불법체류 규정: 프로그램이 이미 종료되고 I-20도 만료된 학생은, 2026년 9월 15일 이전에 법적으로 가능한 신분복원, 신분변경 또는 OPT/STEM OPT 신청을 접수하지 않았다면, 원칙적으로 2026년 9월 15일부터 불법체류가 시작된다고 DHS는 설명합니다.

다만 이 날짜를 모든 과거 신분위반에 일률적으로 적용해서는 안 됩니다. I-20 날짜는 남아 있지만 무단취업, 학업중단, OPT 위반 등이 있었던 경우에는 불법체류 시작일을 개별적으로 분석해야 합니다.

사례 - 프로그램 종료 후 계속 체류: 진은 2025년에 학업을 마쳤고 OPT를 신청하지 않은 채 60일의 출국 준비기간이 지난 뒤에도 미국에 머물렀습니다. 2026년 9월 15일 이전에 적법한 신청이 없다면, 최종 규칙에 따라 그 날짜부터 불법체류가 시작된다고 보수적으로 판단해야 합니다.

불법체류가 180일을 초과하면 출국 후 3년 입국금지, 1년 이상이면 10년 입국금지가 적용될 수 있습니다. INA §212(a)(9)(B), 8 U.S.C. §1182(a)(9)(B). 신분복원은 재량사항이며, 무단취업은 중대한 장애가 됩니다. 8 C.F.R. §214.2(f)(16).

8. 지금 바로 해야 할 일
• 가장 최근 I-94를 내려받고, 지금까지 발급받은 모든 I-20를 모으십시오.
• DSO에게 SEVIS가 “Active”인지, 프로그램 종료일이 정확한지 확인하십시오.
• I-94 만료일, I-20 종료일, EAD 만료일 및 전환기한을 달력에 저장하십시오.
• 재학기록, reduced course load 승인, CPT, OPT/STEM OPT, 실업일수 및 보고이력을 점검하십시오.
• 해외여행, 전학, 전공 또는 학위단계 변경, 두 번째 학위 등록, 프로그램 연장 전에 반드시 확인하십시오.
• SEVIS가 Terminated 또는 Completed 상태이거나, 프로그램/OPT가 끝났거나, 무단취업이 있었거나, 신분유지 여부가 불분명하다면 2026년 9월 15일 전에 개별 법률검토를 받으십시오.

주의: 불법체류 시계를 멈추기 위한 목적으로 근거 없는 “임시 신청”을 접수해서는 안 됩니다. 법적으로 가능한 신청인지, 요건을 충족하는지 먼저 확인하지 않으면 거절과 추가적인 이민법상 문제가 생길 수 있습니다.

주요 날짜

2026년 7월 17일: 최종 규칙 공표, 91 Fed. Reg. 44976.
2026년 9월 15일: 예정 시행일. 의회 검토 또는 DHS 후속 공고에 따라 변경될 수 있습니다.
2030년 9월 15일: 시행일이 변경되지 않는다는 전제하에, D/S 전환 대상 학생의 일반적인 4년 최장 한도.

THE END OF “DURATION OF STATUS” (D/S)
A Practical Guide for F-1 Students

Final Rule Published July 17, 2026 | Scheduled Effective Date: September 15, 2026

The major change: After the rule takes effect, F-1 students will generally receive a fixed expiration date on Form I-94 instead of “D/S.” An extended Form I-20 alone will no longer extend a student’s authorized stay.

1. Start with the Three Documents That Control Your Case
• Visa stamp: permits you to request admission to the United States. It does not determine how long you may remain after entry.
• Form I-20: records your school, program, major, and program dates.
• Form I-94: establishes the outer limit of your authorized admission. You must also continue complying with all F-1 requirements.

Practical rule: Download your I-94 after every U.S. entry and calendar the “Admit Until Date.” A future I-94 date does not excuse unauthorized employment, failure to enroll, or another status violation.

2. How Long May You Stay?
Most F-1 students admitted under the new system will receive the period shown on the Form I-20, capped at four years, followed by the applicable departure period. New fixed-date admissions generally receive only 30 days after program completion, rather than the traditional 60 days. English-language students generally remain subject to a 24-month maximum, plus 30 days. F-2 dependents may not remain longer than the F-1 principal.

3. Already in the United States in D/S? The Transition Rule
If you were admitted for D/S and are properly maintaining F-1 status on September 15, 2026, you generally do not need to obtain a new I-94 immediately. Your transition period ordinarily lasts until the later of:
• the program end date on the Form I-20 valid on September 15, 2026; or
• the expiration date on a valid Employment Authorization Document;
but not beyond September 15, 2030, followed by the preserved 60-day departure period.

Example — current master’s student: Mina entered in D/S, remains enrolled, and has an I-20 ending May 20, 2027. If she remains in status and does not travel, her transition admission generally runs through that program date, followed by the preserved 60-day period. She does not need a new I-94 merely because the rule takes effect.

Travel warning: International travel after September 15, 2026 generally moves a D/S student into the fixed-date system upon readmission. CBP may issue a date-certain I-94. Review travel with your DSO and, if there is any status issue or pending USCIS filing, with immigration counsel before departure.

4. Need More Time? Form I-539 Becomes Critical
A DSO may still extend the Form I-20 in SEVIS, but the school cannot independently extend your stay beyond the I-94 expiration date. To remain longer, you generally must:
1. obtain an endorsed Form I-20 recommending the extension;
2. file Form I-539 with USCIS before the I-94 expires;
3. pay the filing fee and submit the required evidence and biometrics, if requested; and
4. show a legitimate reason, such as documented illness, a necessary research change, or compelling academic circumstances beyond your control.

Academic probation, suspension, repeated failure to complete coursework, or unwillingness to make normal academic progress generally will not support an extension.

If a timely I-539 is pending: You generally may remain and continue full-time study while USCIS adjudicates the application. Do not work unless employment remains independently authorized.

If USCIS denies the extension after the I-94 expires: There is no post-denial grace period. You must depart immediately. Continued presence may begin accruing unlawful presence.

5. Transfers, Majors, and Second Degrees
• Students below the graduate level generally may not transfer schools or change their major or educational level during the first academic year, absent an SEVP exception.
• Graduate students generally may not change their educational objective and generally may not transfer schools during the program without an SEVP exception.
• After completing an F-1 program in the United States on or after September 15, 2026, a student generally may not begin another F-1 program at the same or a lower educational level.

Upward progression remains possible.

Allowed example: Daniel completes a bachelor’s degree and begins a master’s program. This is upward academic progression.

Generally prohibited example: After completing a U.S. master’s degree after September 15, 2026, Sarah seeks a second master’s program primarily to continue working through CPT. Because the new program is at the same level, she generally cannot maintain F-1 status for that program.

CPT itself remains available under 8 C.F.R. §214.2(f)(10)(i), but CPT cannot continue beyond the student’s authorized admission period. Keep every CPT I-20, offer letter, course record, and proof that the training was integral to the curriculum.

6. OPT and STEM OPT
Qualifying D/S transition students generally retain the 60-day post-completion period. Students admitted or extended under the new fixed-date system generally receive only 30 days. The rule also provides temporary transition relief for certain timely filed OPT and STEM OPT applications. Because the filing deadline is technical, students should confirm the exact deadline rather than relying on a general estimate.

Example — STEM OPT: Alex is in valid D/S status and has a STEM OPT EAD expiring June 30, 2028. His transition period generally follows the later of the valid EAD date or the September 15, 2026 I-20 program date, subject to the September 15, 2030 cap.

7. The Urgent Issue: Students Who May Already Be Out of Status
Transition protection applies only to students properly maintaining F-1 status on September 15, 2026. It does not cure an earlier violation, such as unauthorized employment, dropping below a full course load without approval, excessive OPT unemployment, or remaining after the program and departure period.

Express unlawful-presence rule: For students whose programs are completed and Forms I-20 are expired, DHS states that unlawful presence begins on September 15, 2026 unless, before that date, the student has filed a legally available reinstatement request, change-of-status application, or OPT/STEM OPT application.

This rule should not be mechanically applied to every possible preexisting violation. Where the I-20 remains facially valid but the student worked without authorization, stopped attending, or otherwise violated status, the unlawful-presence start date may require individualized analysis.

Example — expired program: Jin completed his program in 2025, used no OPT, and remained in the United States after his 60-day period. If he has no qualifying filing before September 15, 2026, he should conservatively treat that date as the beginning of unlawful-presence accrual under the final rule.

More than 180 days of unlawful presence may trigger a three-year inadmissibility bar after departure; one year or more may trigger a ten-year bar. See INA §212(a)(9)(B), 8 U.S.C. §1182(a)(9)(B).

Reinstatement is discretionary, and unauthorized employment is a serious obstacle. See 8 C.F.R. §214.2(f)(16).

8. Student Action Checklist
• Download your latest I-94 and collect every Form I-20.
• Confirm with your DSO that SEVIS is Active and the program end date is accurate.
• Calendar the I-94 date, I-20 end date, EAD expiration date, and any transition deadline.
• Audit enrollment, reduced-course-load approvals, CPT, OPT/STEM OPT, unemployment days, and reporting history.
• Ask before traveling, transferring, changing a major or degree level, enrolling in another degree, or extending a program.
• Seek individualized legal review before September 15, 2026 if SEVIS is terminated or completed, the program or OPT ended, unauthorized employment occurred, or you are unsure whether status was maintained.

Do not file a placeholder application: An unsupported or legally unavailable filing may be denied and may create additional immigration complications. Filing something is not the same as having a valid period of authorized stay.

Key Dates

July 17, 2026: Final rule published at 91 Fed. Reg. 44976.
September 15, 2026: Scheduled effective date, subject to congressional review and any later DHS notice.
September 15, 2030: General four-year transition cap for qualifying D/S students, assuming the effective date does not change.

미국의 대표적인 전문직 취업비자인 H-1B 비자 제도가 수십 년 만에 중대한 구조적 변화를 앞두고 있습니다. 미 이민국(USCIS)은 2027 회계연도(FY 2027)부터 기존의 무작위 추첨 방식을 폐지하고, 임금 수준을 반영한 가중 선발 시스템을 도입할 예정입니다.

이번 개편은 단순한 절차 변경을 넘어, 고용 시장에서의 전문성과 임금 수준을 보다 직접적으로 반영하려는 정책 방향을 명확히 보여주는 조치로 평가되고 있습니다.

임금 수준별 가중 선발 제도 도입

신입 또는 주니어급 직무

다만, 임금 수준이 높다고 하여 자동으로 선발되는 것은 아니며, 여전히 추첨 절차 자체는 유지됩니다. USCIS의 추산에 따르면, Level IV 신청자의 경우 기존 제도 대비 선발 가능성이 두 배 이상 증가할 수 있을 것으로 전망되고 있습니다.

‘10만 달러 수수료’라는 또 하나의 변수

이번 제도 개편에서 또 하나 주목할 부분은 고액 수수료 규정입니다. 2025년 9월 발표된 행정명령에 따라, 해외에서 신규로 채용되는 근로자를 대상으로는 미화 10만 달러에 달하는 추가 수수료가 부과될 예정입니다.

반면, 미국 내에서 합법적으로 체류 중인 F-1 유학생이나 다른 합법적인 신분을 갖고 있는 사람이 신분 변경을 통해 H-1B 비자를 신청하는 경우에는 해당 수수료가 면제됩니다. 이에 따라 고용주 입장에서는 비용 부담이 큰 해외 채용보다, 미국 대학 졸업생과 미국내 합법 체류자를 우선적으로 고려할 가능성이 높아질 것으로 보입니다.

시행 일정 및 적용 범위

본 규정은 2026년 2월 27일 공식 발효되며, 2026년 3월 초에 시작될 예정인 2027 회계연도 H-1B 추첨부터 적용됩니다.

다만, 이번 가중 선발 제도는 신규 쿼터(cap) 대상 신청자에 한해 적용되며, 현재 H-1B 신분으로 근무 중인 근로자의 연장 또는 갱신 신청에는 영향을 미치지 않습니다.

결론

2027 회계연도부터 적용될 H-1B 제도는 기존의 무작위성 중심 구조에서 벗어나, 임금 수준과 미국 내 학위와 체류를 보다 중시하는 방향으로 재편되고 있습니다. 이에 따라 고용주와 신청자 모두 변화된 규정과 비용 구조를 정확히 이해하신 후, 사전 전략 수립과 전문적인 법률 자문을 병행하시는 것이 매우 중요해질 것으로 보입니다.
