Incredible news! I know so many of our clients will be thrilled as they have been stuck, separated from their families since the ban was announced in late January. This ban has prevented visa applicants from 75 countries, including Colombia, Brazil, Guatemala, Pakistan, and many others from being able to (even though approvable and passing all background checks and having all required paperwork) live here in the U.S. with their loved ones. It's been heartbreaking that for 8 months, we've had to tell newlyweds, children petitioning for aging parents, dying fathers petitioning for adult sons, that their family members cannot come to the U.S. - with no exception - until this ban is lifted. And as per usual, our government did nothing in 8 months to provide guidance or updates - for instance, new evidence to provide to show you have the financial support required, or a new form that would need to be submitted, or additional checks the consulate would need to perform.) No, just silence for 8 months while people are kept in the dark, not able to be with their families. Finally, the ban is lifted. Now, we can get back to work reunited deserving, loving families.

Now we wait to see what happens with any appeal.

The Trump administration’s ban on visas for immigrants from 75 countries was struck down by a federal judge on Friday, who ruled it was “contrary to law” and outside the statutory authority of Secretary of State Marco Rubio.

Joyce Meyer says you can’t be pitiful and powerful at the same time. I repeat this in my head every day as I step into the world of immigration during the most aggravating and exhausting time in my career, while juggling being a foster parent and mom.

But God is God and I either believe or I don’t. Praying, fasting and believing for favor for my clients and their cases and I know He will get the glory.

I’m tired but I choose power. A power only God brings.

Our federal government apparently believes its own memos circumvent actual law. Our nation’s immigration laws dating back to the 50s if not earlier allow for those in the US who were already vetted by immigration - already approved for and here on visitor visas, student visas, work visas, etc - to gain permanent residence (a green card) through a process called “adjustment of status.” Adjustment of Status (AOS) allows someone to apply for their green card in the US without having to leave the US and if approved, the green card is mailed to their home. It’s not an easy, straightforward process but it’s significantly more efficient, less time consuming, less stressful and more manageable than consular processing.

Consular processing requires those who did not enter the US legally to return to their home country and gain status following an interview at the U.S. consulate. It takes years… often 5-8 years … for the entire process to complete. It’s costly, involving multiple agencies, and requires families be separated for lengthy periods of time. Leaving the U.S. also triggers certain inadmissibility bars that require waivers that often aren’t needed for AOS.

To now say that those who for 70+ years have qualified for the simpler process to get legal status now must consular process is abhorrent and will be challenged in federal court. It’s embarrassing that our government issues a “memo” blatantly disregarding longstanding laws and does so immediately before a federal holiday throwing the immigrant community once again into a tailspin.

This is not right. This is not legal. We will fight this in every manner possible and we know federal challenges are already in the works.

For our clients - we will send a detailed message in our client portal on how your case may be impacted in the next few days. For now, absent “extraordinary circumstances” (whatever that means) it’s possible your green card application may not be approved. The good thing - your lawyer believes in God and justice and we will fight this memo and also fight to show you are eligible for your green card even in the face of this memo. In the meantime, breathe, pray, and ask God for favor. We all need it.

USCIS is applying long-standing law and prior court decisions to require certain aliens with temporary visas who decide they want to permanently reside in the U.S. to return to their home countries to apply for permanent visas through the U.S. Department of State.

We're returning to the original intent of the law to ensure aliens navigate our nation’s immigration system properly.

A few weeks ago, we celebrated the two new additions coming to DLF - Emily and Mai are both pregnant - and we had a baby shower to celebrate. I am working on setting up a little nursery at the office, because if you can’t guess I am very pro-mom and I feel such a call for moms who work outside the home and juggle the demands of motherhood. Moms can do anything!

Here’s to these two beautiful moms! We loved celebrating them and cannot wait to be a part of these two little lives.

Nomatter what, we continue to provide excellent service to our clients and moms make things happen! This will only grow their strength and ability to juggle it all and have the fortitude to keep going nomatter what.
