A new federal signature rule just took effect, and it's one of the more unforgiving changes we've seen in a while. Here's the breakdown:

What changed: Effective July 10, 2026, USCIS can now deny — not just reject — an immigration filing if it discovers an invalid signature, even after the case was already accepted and a receipt notice was issued.

Why it matters: A rejection means you get your filing fee back and can refile. A denial is treated as if your case was fully adjudicated against you — you lose the fee, and your only options are to appeal or start over with an entirely new filing.

No chance to fix it: Before this rule, an invalid signature usually meant USCIS caught it at intake and sent the whole package back. Now, if it's discovered later — even months into processing — there's no Request for Evidence, no notice to cure it, nothing. It just gets denied.

What counts as valid: A handwritten, wet-ink signature by the correct person, on the current version of the form. Scanned or photocopied signatures of an original wet-ink signature are still okay — but an image of a signature pasted onto a document is not.

What you should do: Double-check every form before it goes out — I-130s, I-485s, N-400s, EAD applications, all of it. If your signature style has changed over the years, try to stay consistent with what's on file with USCIS.

Before you sign Form I-864, here's what that commitment really means so you can move forward with confidence:

1. It's a legally binding contract, not just paperwork. Signing Form I-864 means promising the U.S. government you'll financially support your relative if they can't support themselves.

2. It doesn't end when the Green Card is approved. The obligation continues long after your relative becomes a permanent resident.

3. Divorce does not cancel it. Even if a marriage ends, the sponsor's financial responsibility typically continues.

4. It only ends under specific conditions:
Your relative becomes a U.S. citizen, earns 40 qualifying work quarters (~10 years), permanently loses status and leaves the U.S., or either of you passes away.

5. You can be sued to enforce it. Courts have recognized a sponsored immigrant's right to legally enforce the sponsor's support obligation.
