There are some good days in the practice of law, and this is one of them.
When my client came in a month ago, someone told her she needed a divorce and I asked why? She was told as her husband was going into a nursing home, she needed to get a divorce in order to protect assets. Opps! That was wrong information someone gave her! She really didn’t want a divorce after over 40 years of marriage; she just wanted to protect their home and assets. I let her know we could achieve the goal of asset protection without divorce. Leaving her in her home, secure her car, and provide for her security.
Over the past few weeks, we have guided her through a division of assets, rearranged her finances, and gathered the documents that verify the financial status at the time her husband went in the nursing home and the financial status today. A cumbersome process but the goal of her having her home; her car; income and savings is complete. The application is in the pipeline, and she may even end up with money back from the nursing home.
It’s a good day when you can see the stress released from your client’s face.
