According to Lady Gaga, her Personal Assistant (a “hood rat" suing for money she didn’t earn) was terrifically pampered. She “slept in Egyptian cotton sheets every night, in five-star hotels, on private planes, eating caviar, partying … all night, wearing my clothes." Unfortunately for Ms. Gaga, those activities and perks probably didn't exempt her Assistant from the overtime requirements of the FLSA. (The most likely argument being the Administrative Exemption, which would require the Assistant to, among other things, exercise discretion and independent judgment with respect to matters of significance to the employer.)

Until very recently, it was pointless to bring same-sex harassment claims in the Fifth Circuit absent proof that the harasser was homosexual, had a gender bias, or treated males and females differently. This case was a big win for the EEOC, and for future victims of workplace bullying.
