In this age of rampant wire fraud, grammar and spelling count more than ever. If you are involved in a real estate transaction and receive an e-mail (allegedly from someone on your team i.e., your attorney, real estate broker, mortgage broker, lender’s attorney) directing you to wire funds prior to closing YOU MUST ASSUME IT IS FRAUDULENT UNLESS PROVEN OTHERWISE.

Here is an example of an e-mail that was sent to one of my clients recently from someone posing as their lender’s agent:
“Banks are now putting hold on cashier check which mean we can’t go on record until the cash are available in our account that would delay the closing, you need to have it wired to us today in order to avoid closing delay. You can have the money wired today and if it is more than the closing cost you get a check at closing. Please let me know if you can take care of it now so I can forward you the wiring instructions.”

One clear sign of fraud (in addition to a bogus or spoofed e-mail address) is EXTREMELY POOR USE OF THE ENGLISH LANGUAGE.

My clients were not fooled by this e-mail because we had discussed the issue of wire fraud on numerous occasions and every one of our e-mail communications contained a wire fraud advisory. NEVER WIRE FUNDS TO ANYONE WITHOUT CONFIRMING THAT THE WIRE INSTRUCTIONS ARE LEGITIMATE.
