No joke, beginning in 2024 business entities, including your LLC or corporation, have a new mandatory filing requirement to disclose the identity of the owners to the U.S. Dept of Financial Crimes (FinCEN). This applies to my law firm, my attorney friends, and our business clients. Those who fail to file face stiff penalties ($500 per day civil fines and potential criminal penalties). Dec. 6, 202 - As part of continuing efforts to combat dubious Employee Retention Credit (ERC) claims, the Internal Revenue Service is sending an initial round of more than 20,000 letters to taxpayers notifying them of disallowed ERC claims. IRS is disallowing claims to entities that did not exist or did not have paid employees during the period of eligibility to prevent improper ERC payments from being made to ineligible entities.

Merry Christmas from Congress: An Update on Deducibility of PPP expenses. On Monday Dec 21 the new COVID relief stimulus package passed in the House with a vote of 359 to 53 before passing in the Senate shortly before midnight with a vote of 92 to 6. We are now waiting for the President to sign the relief bill into law. This relief package allows business owners to deduct expenses paid with the proceeds of forgiven PPP loans, contrary to previous IRS guidance. It also includes stimulus checks of up to $600 per person for individuals earning up to $75,000 per year and married couples who earn up to $150,000, with $600 more for each dependent under 18 living in the same household.
