Harsh times always breed creative criminals that prey on good people in difficult situations.

BOND IS PAID DIRECTLY TO THE UNITED STATES GOVERNMENT

X Not to “à lawyer or notary who says he prepaid it.”
X Not to some rogue ICE agent or some scammer saying they are an ICE agent

Through a special portal or at an immigration court.

X Not by Zelle, Venmo or any other interpersonal cash transfer.

Walking into the weekend on a good vibe.

It’s been ten months. We fought vigorously.

We came out on top.

Due process prevails. Our client had no criminal record. ICE put an incorrect alien number on his report notice, alleged he had missed a check-in, then said “well we don’t have to produce proof that you did.”

The immigration court adjourned a scheduled bond hearing, then signed an order deeming “bond withdrawn” the day BEFORE the rescheduled date.

Hopefully he will be home tomorrow.

It’s so easy to feel powerless as we watch good people targeted for immigration enforcement.

We talk today about three actionable things US citizens can do to be solid allies for our non citizen neighbors.

One important note. It’s considered over reach if you don’t know someone to just walk up to them and ask “ARE YOU ILLEGAL?” Or any versión of that question. For those friends who don’t know that, now you do. It creates tension because the person you’re asking doesn’t know what your intentions are.

So let’s all be good neighbors! The more kindness and support in this world the better we can make it.

Symposium complete! We brought 80 lawyers together today to discuss everything from supporting veteran entrepreneurs to the nuances of representing veterans and service members in DV cases.

Was an honor to present James Fanous, Esq, with the Sandy Rader memorial award. Sandy was a phenomenal attorney, asset to the profession, but also a family friend.

We heard from our keynote, Peter Lupo, of the NJ Veterans Chamber of Commerce, and other knowledgeable speakers.

What a full circle moment. Pulled off with the support of our amazing section members. 🙏🏼

All identifying details of country and family have been removed.

It has been a heavy day during a heavy time. And God put me with a family that reminded me of the very reason I said in high school I wanted to be an immigration lawyer so many years ago.

So next time you want to demonize the “illegals” remember that some- not every single one, but some- come fleeing things we have no notion of as Americans. Remember that you have absolutely no idea what someone has lived in their home country. From r@pe, murder and tortur3 I have seen a lot in ten years. Today I was seriously considering getting out of this field.

It was the privilege of my life to remind this family that justice for their murd3red father and husband didn’t stop because they left their country. And that they could count on me to fight.

It is confusing and frightening when a family member is detained. Our system makes immigration bonds more confusing by using some of the same words and phrases as criminal court.

Totally understandable that folks think “well my family member isnt a criminal and they didn’t do anything serious, why shouldn’t they get immigration bond?”

It no longer works like that.

Immigration judges must assess whether the applicant is a flight risk, danger to person or property, or a security risk.

Typically, the strength of someone’s underlying case to stay is a core pillar of whether an immigration judge will consider them a flight risk. The question they are tasked with deciding is- given the strength of this person’s case are they likely to return to court or show up for deportation.

Unfortunately in this harsh environment, even folks with legal entries (“bUt tHeY dIDnt CrOsS the BoRdER”) ARE GETTING BOND DENIED if they otherwise have absolutely no viable option to “get papers here.”

So this means that even though your family member or friend is a great person, has paid taxes, and maybe has a kid or two here, if they’ve got zero options and nothing pending, wow an immigration bond is not likely these days.
