I see this get missed more than you’d think:
A vehicle gets recalled, something fails on the road, and everyone assumes it’s just a normal accident.
It’s not always.
If a known defect—brakes, steering, airbags—caused or even made your injuries worse, you may be dealing with more than just a typical car accident claim.
That can mean:
– A claim against the driver
– A claim against the manufacturer
– Or both at the same time
Manufacturers are required to notify owners of safety defects and provide a fix. But if the vehicle wasn’t repaired… or the fix failed… that matters.
A lot.
These cases are handled differently. They’re more technical, more detailed, and they require looking at what actually caused the failure, not just what happened in the crash.
