One of my privileges as an attorney is to ask questions of people to test whether what they are saying is true. This is called cross-examination, and sometimes I cannot believe what people say.



Here is a snippet from a deposition taken many years ago of a contractor who put in a retaining wall that collapsed:



Q: Were you satisfied with the job you did?

A: Yes.

Q: But it turned out that not long after the wall fell down.

A: That’s right. The middle fell down.

Q: Should a properly built retaining wall fall down after heavy rains?

A: No.

Q: So what did you determine you did wrong?

A: I didn’t do anything wrong. I went back and made some adjustments, is what I did.

Q: Are you saying that the normal course of construction is to put something up to see if it falls?



And it goes on from there. He doesn’t want to admit that he did anything wrong. We later developed testimony that based upon the height of the wall that he should have tied it back into the hill to use the weight of the dirt to hold the wall in place, and he didn’t do it. When confronted with the manufacturer’s specifications, he had no where to turn.

Before suit, he was given multiple opportunities to fix the work, but he did not fix it. The pool walls were collapsing, and it was unsafe. Suit followed after trying to amicably resolve matters.
