The protests in Los Angeles have been predominantly peaceful (According to the LAPD officers I have PERSONALLY SPOKEN WITH) BUT the individuals who take advantage of these circumstances to destroy property, incite violence, or harm LAPD do not represent the LARGE majority of those who are peacefully protesting (as is their First Amendment right) the acts of ICE. These people SHOULD BE ARRESTED.
ICE is allowed to rescind a conditional release that they previously approved, even if the individual has been properly complying with all terms of their release conditions. While this is unfortunate AND frustrating, it is lawful. You do not need to have any criminal history or a past order of deportation for ICE to exercise its discretion and essentially, "change its mind". 8 C.F.R. § 236.1(c)(8)
Arresting and detaining in a detention facility, individuals without criminal history and without prior orders of removal is a HUGE waste of taxpayer dollars if the individual is complying with the terms of their release.
We do not have an unlimited federal budget allocated by CONGRESS to spend on deportation and enforcement of immigration laws. Why would we waste the money arresting and deporting people who are in compliance with the terms of their ICE conditional release and/or already in immigration removal proceedings, applying for lawful status in the United States, and NOT focus on the individuals in violation of their conditional release agreements and who have past criminal convictions, or orders of removal.
Catching the moms, the dads, the housekeepers, the contractors, many of whom pay taxes, have significant ties to the United States, should be the second priority behind using the resources we have to locate the DANGEROUS individuals and focusing on their immediate removal. But this administration is treating everyone the same, ignoring the fact that in this situation that actually leaves dangerous individuals on the street longer in order to be perceived as being “tough” on immigration.
Therefore, while in many cases, rescinding a prior agreement to release a person from custody may be within the purview of ICE, if they granted release, the manner in which they are going about it is often NOT legal. But furthermore, the methods they are using are simply not justified.
If ICE wants to rescind orders of release, even though X months ago, they did not believe person X was a danger to the community, they can... although even this may violate the law depending on the circumstances. But generally, they can. It doesnt make sense from a budgetary standpoint, or a logic standpoint, but technically they can.
But please think about this...
Is it necessary for ICE to arrest person X in an unmarked vehicle?
Is it necessary that ICE wear masks and refuse to tell the people they are arresting why they are being arrested?
Is it necessary to refuse to explain what has changed and what options the person or their family may have?
Is it necessary to not tell their family where the person is being taken?
Does is make sense to arrest someone already in removal proceedings, who are attending their court hearings, and applying for legal status at court BEFORE their case has been completed?
Basically, is it right to terrorize a person or their family, arrest a dad or mom in front of their kids, destroy a graduation, or humiliate someone, when they could simply say the following:
"I'm Officer X, from ICE. You were granted conditional release, and despite the fact that you have been in compliance with the terms of your release, ICE has rescinded this agreement. There have been policy changes that have led to the rescission of your conditional release. While I am sure this is very upsetting for you, here is a copy of the CFR codes for you to review, and rest assured, in many cases, this was NOT caused by anything you have done since you were granted conditional release.
You have the right to contact an attorney to help you understand your options, and your options MAY include requesting bond from an Immigration Judge, OR re-requesting release from ICE, if you are willing to wear an ankle monitor or post a bond, etc.
We will leave this flyer with your family on the door, so that they know where you are being taken and why."
Why do a thing because you can is the cruelist way possible, in the most illogical way possible?
Go arrest the individuals in the US illegally with serious violent convictions, not the ones complying with conditional release terms, with pending applications, and zero criminal history. Doing so makes America actually safer, and you would NOT have to violate Due Process to do it!
