Harvie Branscomb came to Corpus Christi in 1949 having graduated from Yale Law School and completing military service in the US Navy. His uncle, Ben Vaughan, and Harvard Law School graduate from Dallas, TX, had married a girl from Beeville and opened a law office in Corpus Ch

risti, TX. Harvie initiated practice with Uncle Ben but eventually started his own firm which became known as Branscomb, Gary, Thomasson, Hall and Marks. Ray Miller joined the firm around 1964. In 1975, Ray and Harvie left the old firm and established Branscomb and Miller. They quickly added three more experienced attorneys, including Michael Stukenberg, who joined as a new graduate in 1976. In 1980, the firm expanded to San Antonio and opened a small office there. In 1982, the office merged into the old line San Antonio firm of Matthews, Nowlin, McFarlane and Barrett, and formed Matthews and Branscomb with offices in San Antonio, Corpus Christi and Austin. The San Antonio group left around 2005, and at that point, and the firm become Branscomb PC with the only office in Corpus Christi, TX. The firm eventually expanded back into San Antonio and Austin becoming Branscomb Law.

Branscomb Law elected Amanda Torres as its new Firm President. A member of the firmโ€™s Litigation Practice Group, Amanda has served on Branscombโ€™s Board of Directors for the past four years and brings a wealth of legal and leadership experience to her new role.

Amanda is a 2002 graduate of Texas A&M University and 2007 graduate of St. Maryโ€™s University School of Law. In addition to her leadership roles within the firm, she has served the legal community in various capacities, including as a director of the Texas Young Lawyers Association and the Corpus Christi Bar Association. Amanda previously served as Justice of the Peace for Precinct 1, Place 1, and as Judge of County Court at Law No. 5 in Nueces County, Texas.

Amanda succeeds Omar Leal, who served as Firm President for the past two years. Under Omarโ€™s leadership, Branscombโ€™s growth and reputation for excellence in legal services thrived. Amanda is excited to continue strengthening Branscomb and the services it provides to its clients.

๐๐จ๐ง-๐‚๐จ๐ฆ๐ฉ๐ž๐ญ๐ž ๐Ÿ๐จ๐ซ ๐ƒ๐จ๐œ๐ญ๐จ๐ซ๐ฌ ๐š๐ง๐ ๐Ž๐ญ๐ก๐ž๐ซ ๐Œ๐ž๐๐ข๐œ๐š๐ฅ ๐๐ซ๐จ๐Ÿ๐ž๐ฌ๐ฌ๐ข๐จ๐ง๐š๐ฅ๐ฌ

SB 1318 went into effect on Sept. 1, 2025. This new law amends Chapter 15.E of the Business and Commerce Code pertaining to restraints of trade. The amendments to Chapter 15.E are listed below, and these changes expressly apply only to non-compete agreements entered or renewed on or after Sept. 1, 2025. Non-competes signed or renewed before Sept. 1, 2025, will be governed by the former version of the code.

๐’๐œ๐จ๐ฉ๐ž ๐จ๐Ÿ ๐‚๐ก๐š๐ฉ๐ญ๐ž๐ซ ๐Ÿ๐Ÿ“.๐„ ๐€๐ฆ๐ž๐ง๐๐ž๐. SB 1318 clarifies that the specific restrictions applicable to medical practitioners do not apply to a person whose practice consists of merely managing or directing medical services in an administrative capacity for a medical practice or other healthcare practitioner. However, SB 1318 clarifies that these restrictions do apply to licensed nurses, physician assistants, and dentists.

๐…๐ข๐ฏ๐ž-๐Œ๐ข๐ฅ๐ž ๐‘๐š๐๐ข๐ฎ๐ฌ. Non-competes must now be limited to a five-mile radius from the physicianโ€™s primary practice location at the time of termination.

๐Ž๐ง๐ž-๐˜๐ž๐š๐ซ ๐“๐ž๐ซ๐ฆ๐ฌ. Non-compete restrictions must now expire one year after the termination of the physicianโ€™s contract or employment.

๐‚๐š๐ฉ๐ฌ ๐จ๐ง ๐๐ฎ๐ฒ๐จ๐ฎ๐ญ๐ฌ. Chapter 15.E previously required all non-competes to be subject to a reasonable buyout at the physicianโ€™s option. SB 1318 now limits the amount of that buyout to the physicianโ€™s total annual salary and wages as of the date of termination.

๐‚๐จ๐ง๐ฌ๐ฉ๐ข๐œ๐ฎ๐จ๐ฎ๐ฌ ๐‘๐ž๐ช๐ฎ๐ข๐ซ๐ž๐ฆ๐ž๐ง๐ญ: The terms and conditions of the agreement must be stated clearly and conspicuously in writing. Conspicuous has a particular meaning under Texas Law:

๐…๐จ๐ซ ๐œ๐š๐ฎ๐ฌ๐ž ๐‘๐ž๐ฆ๐จ๐ฏ๐š๐ฅ. If a physician is terminated without โ€œgood causeโ€ the non-compete becomes void and unenforceable. The standard for good cause appears to be demanding as it requires: โ€œa reasonable basis for discharge of a physician from contract or employment that is directly related to the physicianโ€™s conduct, including the physicianโ€™s conduct on the job or otherwise, job performance, and contract or employment record.โ€ Emphasis added.

We are currently hiring for a Probate Paralegal.

Role Description

This is a full-time, on-site role for a Probate Paralegal located in Corpus Christi, TX. The Probate Paralegal will be responsible for preparing legal documents, conducting research, reviewing documents, and providing legal support. Daily tasks include assisting attorneys with estate planning, probate proceedings, and communicating effectively with clients. The Probate Paralegal will ensure accurate and efficient completion of legal processes and documentation. Experience with contested matters is a plus!

Qualifications

- Law and Legal Document Preparation skills
- Strong Communication and Research skills
- Experience in Document Review
- Excellent organizational and time management skills
- Ability to work independently and as part of a team
- Paralegal certification or relevant educational background
- Experience in probate or estate planning is a plus
