"Yes, you have the right to take the witness stand if you go to trial. And you have the right not to take the witness stand. If you take the witness stand the prosecutor will be free to ask you any questions. If you have a prior conviction, and possibly just an arrest, it may come into evidence even if it's not supposed to come into evidence, because it may come into trial regarding motive or habit.

For example it might be something like this from the Prosecutor: "Sir, you just stated, you've never been in trouble before, but haven't you been arrested three previous times?"

And then, "Objection, your honor."

A federal Magistrate Judge was giving me a hard time in federal court, for frivolous reasons, such as a typographical error on one of my Motions.

These errors were understandable because I had entered the case late, and substituted in for another Attorney and was trying to catch up on the case.

I went back and reviewed the file and read the "order of detention" signed by the magistrate Judge holding my client in detention without a bond. The Order of Detention was signed before I was hired to represent the client.

I objected to the detention, stating that the Federal Rules dictate that the Judge "shall" make a finding regarding the physical and mental abilities of the accused Defendant, and he did not do so, so the order of detention was invalid.

Of course my complaints were those of substance, and the Magistrate Judges complaints were complaints of form.

It is a much longer story. But this is a fairly common sort of scenario that goes on in courts every day . . . .

Reiner will be back in court for a pretrial hearing September 15.

Generally , if you want a bond lowered, it should be framed and title "Writ of Habeas Corpus to Lower Bond."

In that manner. if the judge refuses to lower the bond , you could appeal the denial.

Generally, all that the alleged criminal clients who are in jail, or in detention, pending trial or the disposition of their case want, is to get out of jail as soon as possible.

Even if it is practically impossible to get them out.

They generally show no concern about what will happen in their case as to being found not guilty, or getting the best plea bargain possible. They do not even want to discuss these issues.

They generally do not care that we could sometimes leverage the fact that they've been in jail awhile to help get a better plea bargain; or, that this time in jail count towards hard time in prison if they get hard time in prison.

The resources of the lawyers time and money would obviously usually be better spent towards getting them the best plea bargain or working on their cases and preparing a defense; however, again they do not seem to care about what ultimately happens.

They are just concerned about getting out of jail as quickly as possible.

The only thing I could say in defense of this way of thinking, is maybe I would think the same thing if I were in jail.
