There are four essential documents you should have in place to cover the many eventualities that could arise that relate to your well-being, your property, and other assets. We are attorneys with extensive understanding of which of these documents, and with which provisions, will best fit your needs. Proper drafting and ex*****on are essential, since if they are not done according to law, they may be ineffective when needed.
A Durable Power of Attorney is a legal document, effective only during your lifetime, which authorizes a person or persons of your choosing to act in your name. There are many ways such a document can be very useful to you, and at times it could be essential.
• If you are out of town for any length of time;
• If you become physically incapacitated temporarily or
permanently;
• If you experience temporary or permanent mental disability;
A Durable Power of Attorney would allow you to authorize a trusted person or persons to do acts in your name, and you choose ahead of time which actions they can take ranging from any and all things you could do yourself to a very narrow set of permitted actions. If you are unavailable or unable to take action for any reason and have not appointed someone else with a Power of Attorney, the result may be very problematic for you and your family.
A Health Care Proxy is somewhat like a Power of Attorney but is specifically designed to authorize someone else to make decisions regarding your medical care, if and only if, you are unable to do so. This issue can arise in many different ways. Typically, people provide copies of their health care proxy documents to their medical providers should they be needed in the future.
A Living Will is a written document that specifies which life-prolonging procedures you may want or not want if you are unable to express your wishes when the issue arises.
Wills and Trusts are mechanisms to control your assets to achieve the desired result. Depending on the details, a will may be sufficient to address your needs, or a trust may add important details and flexibility. You may create a will simply to communicate how, and to whom, your assets are to be distributed. Both trusts and wills designate trusted individuals to effectuate them. Many trusts are designed to be effective immediately, to accomplish a variety of objectives, including avoiding probate, protecting assets from creditors, making provision for children or grandchildren with special needs. In your trust and/or will, you also appoint a trusted person or persons to implement the provisions if you no longer wish to do so or become unable to do so.
