As Seen in the News: Jacqueline Calderin, serving as court-appointed receiver for GLG Investments and related entities, has filed Chapter 11 petitions on behalf of the four companies amid complex ownership and creditor disputes involving a portfolio of 105 South Florida rental properties.

Agentis attorneys Robert P. Charbonneau and Paula A. Martinez are serving as counsel in the Chapter 11 proceedings, with Charbonneau representing the receiver pre-petition and serving as lead counsel in the Chapter 11 reorganization. Recently featured in the South Florida Business Journal, the matter involves significant restructuring, litigation, and receivership issues tied to distressed real estate assets across Miami-Dade and Broward counties.

According to the article, Charbonneau noted that the companies own 104 rental properties in Miami-Dade County and one in Broward County, many of which are occupied by low-income residents, including tenants utilizing Section 8 housing vouchers. Calderin also explained in court filings that the bankruptcy process is intended to help stabilize operations, address the ownership dispute, and allow the debtors to pursue a restructuring plan while working through ongoing litigation and creditor claims.

It is the type of complex insolvency and restructuring work Agentis regularly handles, particularly in matters involving distressed real estate assets, business disputes, and Chapter 11 proceedings throughout South Florida.

Agentis in the News! Our team is representing the Asociación del Fútbol Argentino (AFA) in a high-profile lawsuit filed in the U.S. tied to a series of international exhibition matches involving Lionel Messi.

The plaintiff alleges it lost millions of dollars, claiming Messi was expected to play a set amount of time during the matches but ultimately did not play in one of the two matches as anticipated.

Our position is straightforward. As trial partner Javier J. Rodriguez shared with NBC 6 South Florida, Telemundo, and HUDD Sports: “We view this as a very basic contract dispute.”

The agreement specifically contemplated the possibility of non-participation and included a liquidated damages provision addressing that scenario. AFA also intends to pursue its own claims for amounts it contends remain unpaid.

This is where contract language, expectations, and risk allocation are tested in real time.

Momentum is building. After introduction in the Senate, legislation to restore the $7.5 million Subchapter V debt limit is now advancing in the House.

On March 26, the House Judiciary Committee approved H.R. 7730, a bipartisan bill sponsored by Ben Cline, which would permanently reinstate the higher eligibility threshold for small business reorganizations. This follows a companion effort in the Senate led by Charles Grassley.

If this legislation is enacted, it would expand access to Subchapter V, allowing more small businesses to restructure debt, stay operational, and avoid the cost and complexity of a traditional Chapter 11.

S. 3977 proposes raising the debt limit for Subchapter V small business bankruptcies to $7.5 million, potentially allowing more companies to access this streamlined reorganization process instead of traditional Chapter 11.

Attorneys Javier J. Rodriguez and Izabella Mojica prevailed before the Florida Third District Court of Appeal, successfully defending the summary judgment they secured at the trial court level in a real estate commission dispute.

The case focused on whether a broker was entitled to a commission under Florida’s procuring cause doctrine, which determines when a broker’s efforts are the direct and primary cause of a completed transaction. The trial court found that the undisputed facts did not support the broker’s claim, and the appellate court affirmed that ruling in full. The court also granted their motion for attorneys’ fees, further reinforcing the strength of the client’s position.
