According to public filings, the developer now alleges it knew the building experienced uneven settlement and foundation-related issues during construction — issues that reportedly contributed to substantial delays and damages. Meanwhile, the association’s lawsuit alleges widespread latent defects throughout the property, including structural cracking, water intrusion, system failures and unresolved code-related concerns.

“Our clients purchased homes in what was marketed as a premier luxury development. Associations and owners should never be left to absorb the consequences of known construction and structural issues that were allegedly identified during development and not properly resolved,” said Nicholas D. Siegfried, counsel for the association.

Cases like this serve as an important reminder for condominium associations and boards: early investigation, expert evaluation and proactive legal guidance are critical when signs of construction defects begin to surface.
