$750,000 SETTLEMENT

The Gutierrez Firm secured a $750,000 settlement for a client injured in a slip and fall in a supermarket bathroom.

When referring counsel brought us into the case, a low offer was on the table. Working together, we quadrupled that offer—reaching an amount at which our client decided to resolve the case.

Friday’s NTSB preliminary report details the September 6 crash at Miami International Airport involving a 21 Air cargo flight operating on behalf of Amazon.

According to the report:

• The first officer repeatedly warned of excessive speed during the approach, without receiving a consistent verbal response.
• The aircraft touched down approximately 3,750 feet beyond the runway threshold.
• The speed brakes remained stowed, and the thrust reversers did not deploy during landing or rollout.
• Go-around thrust was applied with approximately 930 feet of runway remaining.
• The aircraft left the runway at 113 knots before striking vehicles on the ground.

Five people died, and three others suffered serious injuries.

These are preliminary findings. The investigation remains ongoing, and the NTSB has not issued a final determination of probable cause. The report nevertheless raises serious questions that require thorough investigation and answers.

For Carlos Acosta Fajardo’s surviving family, those answers are deeply personal. Behind every technical detail is a husband, a son, and a life cut short.
