Nice win for our clients! This particular opinion beat up everyone a little bit, as good opinions tend to do, but the result is what we wanted!

Look for the rest of the story

“... and then, Your Honor, that man right there arrested me, sitting on my front porch, reading my Bible. Me and ... my Bible!”

I’d just entered Chancellor Ron Thurman’s courtroom on another matter while this gentle looking elderly man testified to this. People don’t usually get arrested for front porch Bible reading in Putnam County, so I listened for the rest of the story.

The judge asked “Mr Johnson, was anything else on that swing with you other than a Bible?”

“Well, yes Your Honor.”

“What was it?”

“My .38 pistol Your Honor.”

“Was it loaded, Mr Johnson?”

Mr Johnson laughed and said “Don’t do much good unloaded does it?”

The judge smiled a bit and nodded.

“Had you been anywhere before you got to your swing Mr Johnson?”

“Yes, I’d been to see my neighbor. To tell him I forgave him.”

“Did you have anything with you?”

“Well yes. My Bible.”

Judge asks “Anything else?, Mr Johnson?”

“Well yes. My pistol.”

“Was it in your other hand from the Bible Mr Johnson?”

“Yes Your Honor.”

So many times when we hear a story, the teller remembers the Bible but forgets to mention the pistol. It’s usually a good idea to ask about the rest of the story.

Help for small businesses!

The US Small Business Administration is taking applications for loan/grants of up to $10k to help us keep people employed through this downturn. This is part of the recent government stimulus measures.

Basically the SBA will direct deposit up to $10,000 in relief, and as long as at least 75% of the funds are used to keep employees working, then next year it is forgiven on your tax return.

Here are the details, see what you think and if I can be of help, there is a link to submit an application. The application takes about 10 minutes if you have your tax and bank info handy.

This loan advance will provide up to $10,000 of economic relief to businesses that are currently experiencing temporary difficulties.

Life has slowed; not stopped. This worldwide crisis has made many look at their situation in a new light. While being grateful for the many good things, sometimes we find things that need to be changed or addressed.

I am here to help if you need me. The “shelter in place” order requires my law office to handle business differently, but make no mistake: our office is functioning just fine. How? Through the internet. Here’s how:

1. The courts are closed for in person hearings but can still be accessed for hearings telephonically and through videoconferencing like Skype.

2. Clerks are accepting filings via fax and mail.

3. I can be reached by email at [email protected]. Clients, judges, clerks, prospective clients, other lawyers etc can get to me quickly and easily.

4. You can call the office line at (931) 528-4000. My dedicated staff has opted to stay on the job either working from home or with a 6-ft space at the office, their choice. If our offices are closed by government order and we must work from home, the number will be forwarded. We can be reached to help you.

5. We can talk over the phone preferably with a scheduled phone consultation.

What can we do? We can advise about wills and trusts; we can prepare documents; we can discuss what it takes to use the courts to get you and your family where it needs to be. We can consider filing during this challenging time, or after we come through it.

As we pray for the families and first responders reeling from the disaster that hit our community, it seemed timely to share some basic advice regarding what to do if you suffered damage or loss in these storms:

1. Make sure things are safe to return. Watch for downed power lines, flooded roads and hanging debris. Heed the instructions of first responders.

2. Take pictures. This documents the damage before clean up happens.

3. Call your insurance agent. Write down names, numbers and all relevant info.

4. Beware of scams. It’s sad to say but some sorry people try to take advantaged people in their time of need. Don’t authorize any contractor without clearance from your insurance adjuster and NEVER pay a contractor until the work is at least partially done - and not in full until the work is done.
