Contrary to popular belief, neither partner is required to vacate the marital home during divorce proceedings. If both individuals have been residing in the home, they retain the legal right to occupy the residence. Until property distribution is outlined in the final divorce decree, one party is evicted, or the court renders temporary orders, both parties maintain this right.

However, sometimes it may be beneficial for one party to move out sooner rather than later, particularly for the well-being of any children involved. This decision should be carefully discussed with the help of your attorney.

How long does it take to get a divorce in Texas?

The time it takes to finalize a divorce varies for each couple. Texas law requires a waiting period of at least 60 days from when the divorce petition is filed. However, this waiting period can be waived in cases of domestic violence.

On average, a divorce in Texas typically takes between 6 months to a year to complete. Simple, uncontested divorces may be finalized in as little as 2-3 months, while contested divorces can take up to 2 years, depending on the complexity of the case.

At Adam W Dietrich PC – Family Law, we understand that every divorce is a unique opportunity to help our clients protect their children, safeguard their assets, and achieve justice.

At Adam W. Dietrich PC – Family Law, we understand that every divorce is a unique opportunity to help our clients protect their children, safeguard their assets, and achieve justice. We’re here to provide you with compassionate guidance through any of the following scenarios:

✔️ Uncontested Divorce:
An uncontested divorce occurs when both spouses are in agreement on the major aspects of their separation. While this may seem straightforward, the implementation can be complex. We can help craft fair and comprehensive agreements, ensuring your interests are fully protected throughout the process.

✔️ Contested Divorce:
In a contested divorce, disputes over crucial issues prevent a mutually agreeable resolution. These cases often require legal intervention and, in some instances, courtroom litigation. We are experienced and dedicated to advocating for your rights to guide you through this process.

✔️ Mediated Divorce:
Mediation allows both parties to engage in constructive dialogue facilitated by a neutral third party. As your trusted advocate, we work diligently to ensure that any mediated agreement is equitable and meets your needs.

✔️ Collaborative Divorce:
The collaborative divorce process is for couples committed to working together to dissolve their marriage amicably. Our role as your legal representative is to facilitate productive negotiations, with the aim of minimizing conflict and avoiding the time-consuming and costly nature of traditional court proceedings.

No matter the path your divorce takes, you can rely on our expertise and compassion to help you navigate this challenging time. Visit our website to learn more: adtxlaw.com

What's the difference?

Joint Managing Conservatorship (JMC)

A Joint Managing Conservatorship is the presumed conservatorship appointment under Texas law. This is when both parents share the rights and duties of raising their children. In a JMC, parents share decision-making responsibilities about most issues, including education and healthcare. It does not necessarily mean the child’s time is split equally between the parents, however. The amount of time a child spends with each parent is determined by a possession order.

Sole Managing Conservatorship (SMC)

In a Sole Managing Conservatorship, one parent (or sometimes a nonparent) has the exclusive right to make most decisions about the child. The courts typically grant an SMC when the evidence shows one parent is unfit to make critical decisions for their child. For a parent to obtain an SMC, they typically must show the other parent has a history of violence, neglect, abuse, or other case-specific evidence showing why JMC is not in the child’s best interest.

We offer assertive and diligent representation in Texas child custody cases. If you are a parent contemplating a divorce, a single parent, or a relative concerned about the well-being of a child in your life, contact us today at (936) 703-3127.

The term “best interest of the child” is a legal standard. In Texas, when it comes to deciding who gets custody of a child or the possession and access to a child, this means the courts focus on what's best for the child above all else. They consider factors like the child's needs, safety, health, and overall well-being.

While there's no exact definition of what's best for a child, judges take many things into consideration. The main goal is to create a parenting plan that promotes the child's safety, happiness, and overall welfare.

Having a strong attorney who can help promote your child’s well-being is crucial. Reach out to us today for personalized guidance at (936) 703-3127.
