Our client, 88, moved out of her home to assisted living only to find that a high flying real estate/mortgage broker had obtained unintended documents of half ownership and non existent loans. The broker pounced on the home, rented it out to others, conducted a sham foreclosure. We are in the midst of litigating against the broker and phony foreclosure service in hopes of straightening it out by the force of the law, but it is very dire. Help your elders who might be getting more helpless and lonely and vulnerable, to be wary and wise of sudden "best friends" who may turn out to be amoral swindlers.

Chris Lucas is litigating theft of our client’s home by financial elder abuse. The truly criminal predators are not truly savvy about title questions, and no match for Chris’s knowledge and experience. But they are masters of deception and evasion and exploitation of the courts, and file disingenuous papers which beg every question. Their prey are unwitting and vulnerable elder victims who have unknowingly signed over title to their homes, by signatures on documents cleverly inserted into stacks of otherwise valid documents such as purchase or refinance.

Christopher R. Lucas at Goforth and Lucas, is still Working HARD on “quiet title” cases. These legal actions require a court filing and sometimes service of summons, publication in the paper. Leftover liens or deeds of trust which once secured mortgages that were paid down need to be “re conveyed “ meaning signed off by the lender once the loan is paid. What happened a lot in the subprime loan period, loans written off, but the securing deeds of trust remain as clouds on title that only court action can clear. Do not wait until there is an escrow open on a property you need to sell only to find that your buyer cannot get title insurance. Better call Chris.

Bay Area remodel work going gangbusters- watch out for unlicensed contractors. They are out there with misappropriated licenses, and lack of training and judgment can be devastating.
Because we are disposed to invest in upgrades when our home values are sky high, there are lots of competing estimates available. Your real estate and construction attorney Chris Lucas warns you- watch out for deliberate under bids designed to entice you into a remodel contract which the contractor then delays and forces extensions and increases the price by multiple change orders. This was intended all along by the contractor who obtains the job with a low estimate they do not intend to honor.
When time for agreed completion has long passed and the price has increased, time to call Chris to straighten out the contract and use the law and regulations to get it finished as agreed. Since this may cost the contractor, you need an expert attorney to lay down the law.

Watch out for the underbid home improvement proposal from the contractor! Underbidding is against the law! With property values so high and very few who want to sell (and leave the Bay Area? Forget it!) many of us are willing to upgrade our homes with "Home Improvement Contracts". Licensed general contractors are all too happy to make your former suburban bungalow into your dream house with gleaming new bathrooms and kitchens. At a price.

BUT the frenzy to remodel and upgrade brings out the worst type of scheme by the crafty and unethical vultures who always abound in times of economic upswing: unethical contractors with a fraud in mind.
Their bid for the work is 30- 40% less than your other proposals, and yet this low bid contractor says he or she can finish quick and seems legitimate. But by the time the first completion date arrives, the home improvements are not half done and the extras have been piled on unsustainably, yet to replace the contractor promises even bigger losses. CALL CHRIS FIRST. And if you get stuck with an unethical contractor like a cat on a hot tin roof, the best bet is to fire him and complain to the Contractors State Licensing Board-- and call Chris. The situation will not improve without expert legal help.
