A majority of Americans (67%) don’t have any estate planning in place. Without estate planning, if you’re incapacitated, it will be up to a judge to decide who makes your medical and financial decisions. It requires your loved ones to ask the court to appoint them to be your conservator or guardian, and the judge will determine who he/she thinks is the best person for the job.

A will is your basic instruction manual for what happens to your assets after you die, but it still requires your family to go through the probate process. While a will allows you to name guardians for your minor children and specify who gets what, your personal representative must file the will with the court and potentially wait months or maybe even yers before receiving your assets. Plus, everything becomes public record - so anyone can look up what you owned and who got it.

With a trust, your assets can be passed to the people you choose without a court process and completely privately. You write the rule book! Think of a trust like a container that holds your assets during your lifetime and then, upon your incapacity or death, a successor trustee you've named can step in and manage your affairs. They can pass assets to the beneficiaries you choose in the way you choose.

And, without either of those, you still have a plan - it's the plan chosen for you by Massachusetts, and you may not like it. Almost certainly, your loved ones won't like it because it means they'll likely need to deal with a court process called probate. Your assets are distributed according to state law and a judge decides who gets what. This could mean that your assets go to the people you'd want. But, it could also mean that your assets wouldn't go to the people you choose the way that you'd choose. It also means your family could face a length, expensive, and public process during an already difficult time.

People always ask when they should start estate planning. The reasons that someone first considers estate planning is different for everyone. But, usually it’s tied to a big life event.

Sometimes it’s because they turned 18 and their parents had them start the process. Sometimes it’s because they got married, bought a house, or had a baby. And, sometimes it’s because they saw someone close to them go through a situation that required estate planning.

Everyone over 18 should have at least basic documents. As time changes and your life changes, you can always update and add to your plan. But, once you’re an adult, no one has the ability to make medical or financial decisions for you unless you document your wishes. That means in an emergency, without documents, your parents, your partner, or your spouse would need court permission to make decisions for you.

So, if creating a will or a trust has been on your list or is something you have questions about, I invite you to reach out an ask. It doesn’t cost anything to start getting your questions answered. Beginning on January 1, 2024, the Corporate Transparency Act (CTA) will require small businesses to disclose the names of any owners who hold a 25% or more ownership interest in the company, as well as individuals who exercise significant control over the company’s activities. This new rule also applies to Trusts that own or control a company.

If you or your family own a business or have a Trust that owns a business, you’ll be required to file a report under the CTA. And, if you plan to create a new company next year, your reporting deadline could be as soon as 30 days after the date of its creation.

There’s a way to get more time to file the required report, but you need to act before the end of the year.
