A family trip to Six Flags ended in an unimaginable tragedy.

42-year-old Hassan Jihad Ibn Kariem was riding the Goliath roller coaster at Six Flags Over Georgia when he was reportedly ejected from his seat.

He struck other passengers before falling beneath the ride.

He lost his life.

Now, investigators are trying to determine exactly what went wrong.

And new witness accounts are raising serious questions.

According to reporting from the Associated Press, one family says a safety restraint on the same roller coaster repeatedly came unlocked approximately an hour before the fatal incident.

Now 11 roller coasters across North America have reportedly been temporarily shut down for safety reviews.

⚖️ So who's responsible?

When you purchase a ticket to an amusement park, you're accepting certain inherent risks associated with the rides.

But that doesn't automatically mean you're accepting the risk of negligent maintenance, unsafe operations, or defective safety equipment.

A wrongful death investigation could examine:

👉 Were the restraints functioning properly?

👉 Did employees follow the correct safety procedures?

👉 Were there previous complaints or warning signs?

👉 Was the ride properly maintained and inspected?

👉 Could a design or manufacturing defect have contributed?

And here's another important detail:

The ride passed its most recent state inspection in March.

But passing an inspection doesn't automatically rule out negligence or an equipment defect.

Investigators have not yet determined what caused this tragedy, and the witness allegations remain unproven.

⚖️ REALITY

Amusement parks have a responsibility to take reasonable steps to protect their guests.

If someone loses their life because of a preventable safety failure, the people or companies legally responsible may face a wrongful death claim.

A family went to celebrate a birthday. They never imagined they'd be planning a funeral.

⚖️ A judgment and a collection are two very different things.

Winning $55 million in court doesn't mean the family suddenly receives a $55 million check.

And even if the person responsible has little or no money today, that doesn't necessarily make the lawsuit pointless.

A civil judgment can establish financial accountability and potentially allow a family to pursue assets and future income.

Think about it.

What if someone convicted of murder becomes the subject of a lucrative documentary, book deal, or other commercial project?

Depending on the law and how the deal is structured, money they become entitled to could potentially be pursued to satisfy the judgment.

And in this case, more than $41 million of the award is punitive damages — intended to punish particularly wrongful conduct and deter similar behavior.

⚖️ REALITY

Sometimes a wrongful death lawsuit isn't just about what can be collected today.

It's about accountability.

It's about protecting the victim's family.

And it's about establishing that someone responsible for taking a life should not be able to simply move forward financially without facing the consequences.

You can't put a price on someone's life.

But our civil justice system can still hold the person responsible accountable — even when collecting the full judgment may never be possible.

According to the arbitration findings, the driver argued about a cleaning fee and left both women in an unsafe location.

Emily was subsequently struck and killed by another vehicle.

Now, an arbitrator has awarded her parents $40 MILLION.

⚖️ But here's where this case becomes especially important.

Uber argued that its driver was an independent contractor and that the company shouldn't be legally responsible for his actions.

The arbitrator disagreed.

He found the driver negligent and held Uber responsible, concluding that the company owed its passengers a duty of care that it couldn't simply avoid by classifying drivers as independent contractors.

And there's another troubling allegation.

The family says Uber proposed confidentiality terms that would have imposed a $10 million penalty for speaking publicly about the case. Uber says it ultimately did not pursue those terms.

Uber disputes the finding that it was legally responsible.

⚖️ REALITY

When someone pays for a ride home, they're trusting that company and driver to get them to their destination safely.

A driver doesn't necessarily have the right to leave passengers in a dangerous location simply because something went wrong during the ride.

And a company doesn't automatically escape legal responsibility just because the person behind the wheel is classified as an independent contractor.

$40 million won't bring Emily back.

But her family's fight raises an important question for every rideshare passenger:

Who is responsible for your safety when you get into that car?

A case can potentially be worth eight figures. That doesn't mean eight figures will actually be recovered.

Chris takes a look at the potential civil side of the tragic Malibu crash that killed four Pepperdine students.

Prosecutors allege the driver was traveling at extremely high speed before losing control on PCH. The criminal case is still pending, and the defense disputes the prosecution's case.

From a personal injury perspective, Chris sees another important question:

If the damages are enormous, where does the money actually come from?

Insurance coverage, assets, additional responsible parties and other potential sources of recovery can become just as important as establishing the value of the loss itself.

Because there's a big difference between obtaining a large judgment...

and actually being able to collect it.

The insurance company offered you $50,000. Should you take it?

Maybe.

That's the problem with judging a settlement by the number alone.

$50,000 could be a good settlement. It could also be nowhere near enough.

What are your medical expenses? Are you finished treating? Will you need future care? Did you lose income? Are there reimbursement obligations or liens? What insurance coverage is available? And how has the injury actually affected your life?

Until you understand the details, the number doesn't tell you enough.

That's why Chris isn't interested in guessing what someone's case is worth.

Sit down. Look at the facts. Know the numbers.

Then make the decision.

It's one of the first questions people understandably want answered after a serious injury.

But on the first phone call?

There may simply not be enough information to give you an honest answer.

How much treatment will you need? What will the medical expenses look like? How much work will you miss? Will the injury fully heal—or affect you years from now? What insurance coverage is available? What does the evidence show?

Those things take time to understand.
A big promise might get someone to sign. That doesn't make it an honest evaluation of their case.
