Tony Clymer has been a major player in a wide variety of commercial and residential real estate transactions as well as criminal and civil litigation matters for more than twenty-eight years. He is a former assistant prosecuting attorney for Franklin County, Ohio where he gained significant experience in criminal law and appeals. Upon entering the private practice of law in 1995, Clymer began to r

epresent individuals in residential real estate sales and leasing transactions as well as in eviction and foreclosure proceedings. He also obtained his real estate sales license and title insurance license and was instrumental in the closing of several real estate transactions. Clymer also worked with small businesses in the creation of real estate investment limited partnerships, joint ventures and the formation of limited liability companies and corporations. In 1999, Clymer became an in-house real estate attorney with a real estate investment company where he led the deal team in legal and financial due diligence, executive summary preparation and deal presentations for several low-income tax credit transactions across the country. He was also solely responsible for closing several million dollars in pre-development loans made to general partner real estate developers. Over a one year period, he negotiated, closed and funded nearly thirty million dollars of debt and equity financing. Clymer moved from Columbus, Ohio to Miami, Florida to become a real estate title attorney with Lawyer’s Title/Commonwealth Title where he was involved with the underwriting of several hundred million dollars of title insurance for commercial and residential transactions including golf courses, resorts, hotels, office buildings, mixed-use projects, high-rise condominium developments, and single family home developments. In 2008, Clymer became an in-house attorney with Centres, Inc., a nationwide commercial real estate developer. In his role, Clymer was responsible for all title insurance and survey matters as well as the closing of several multi-million dollar land acquisitions and development transactions across the country. In 2010, Clymer became active with the National Organization for the Reform of Ma*****na Laws in Miami, Florida. He is a former member of the Board of Directors of Florida NORML. He also served on the Board of Directors of a 501(c)(3) Non-Profit Company called The Silver Tour, which was established by Robert Platshorn in order to educate senior citizens regarding the medical benefits of cannabis. Clymer utilized his legal and business expertise while serving on these boards and was instrumental in presentations, lobbying efforts and in being part of the "Yes on 2" Statewide leadership team in Florida who campaigned for medical cannabis there in 2014. In May, 2015, Tony moved back to Columbus, Ohio with his wife of twenty years Ann in order to be closer to friends and family and so he could parlay his vast experience into his own law practice. Please contact my office as soon as possible if you have been issued a medical cannabis recommendation and/or medical card by an Ohio physician and have then been arrested and/or charged with cannabis possession regardless of the card.

I have several people who want me to pursue legal action against these physicians and others for damages they have suffered as a result of this intentional fraudulent conduct.

People are still being arrested and prosecuted around the State even though they have this “medical card”. HB 523 may provide an affirmative defense but this does not deter law enforcement from pulling you over and charging you with possession. It then becomes a crap shoot as to whether you are prosecuted or not.

These doctors are putting “patients” at risk by telling them it is OK to take your “Ohio medical card” to cannabis dispensaries in Michigan to purchase product. NOT LEGAL!!!

I am close to moving on this but want to give anybody out there an opportunity to contact me to become part of this group of potential plaintiffs.

I am, and continue to be an advocate for the legalization of cannabis, however I cannot continue to stand silent while these Doctors are getting rich by bringing in thousands of dollars a day issuing meaningless documents and putting “patients” at risk of harm instead of helping them. It must stop but I need your help.

As some of you out there know, I have been looking into the practices of certain cannabis medical groups and their physicians who have been and continue to write fraudulent recommendations and supply fraudulent medical cards to individuals and then send them to back door dispensaries in Michigan to purchase medical cannabis products. These so called “patients” are then being pulled over and arrested by the Ohio State Highway Patrol when they get back into Ohio and charged with drug possession offenses and they are continuing to be prosecuted even though they have been assured by their physician that the practice is totally legal when it is far from being so.

I have at least four Plaintiffs who want me to bring an action against these physicians and the medical group for their fraudulent and negligent acts for the damages that they have had to suffer as a consequence of being arrested and prosecuted. While some Counties in Ohio may recognize the affirmative defense provided in HB 523, many could care less and state that they will continue to arrest and prosecute until the law goes into effect in September.

I am moving forward with this matter in the very near future so I am requesting that anybody who has been issued a medical cannabis recommendation from a physician in Ohio and who has then been arrested and/or charged with a criminal offense for possessing cannabis to contact me ASAP. You may be a potential plaintiff.

I am, and always have been an activist for the legalization of cannabis, and I understand the intent of the doctors, but they simply cannot be permitted to endanger the freedom, livelihood and relationships of patients who are relying upon these doctors to help them and not do harm to them. These physicians are making thousands of dollars a day issuing these meaningless documents and cards while the State of Ohio does nothing to them but continues to arrest and prosecute patients. This must not be tolerated and it is about time somebody does something.

OK, so you are getting ready to buy or sell a house and you have contacted your realtor friend or friend of a friend. Don't let them convince you that you do not really need an attorney involved in the deal unless something becomes an issue. This, in my personal opinion, is the number one reason why things ever become issues in the first place. With all due respect to my realtor friends out there, real estate attorneys are an invaluable part of the home buying or selling process from the inception of the deal through the closing and title insurance.

A seasoned real estate attorney will be able to assist sellers with valuation and pricing, multiple offer considerations, contract deliveries, requests to remedy, price negotiations, title insurance and closing matters, and deed or additional document drafting. We are not just needed for title and closing, as some people may think.

With respect to buyers, a real estate attorney can offer assistance with offer evaluation, purchase contract drafting, obtaining financing, requests to remedy, price negotiation, title commitment and document review, closing statement and closing document review/consultation and attendance at closing.

I am not claiming that my realtor friends cannot perform some of these services, I am simply suggesting that involving a real estate attorney in all aspects of the transaction will significantly increase the chances of smooth sailing all the way to the closing table. I believe that having an attorney involved right along with your realtor is one of the wisest things you can do in a real estate transaction.

"Attorneys cost too much" most people will say. Not so is my reply. I offer all of the services described above for a flat fee (residential transaction) depending upon my involvement and whether I handle the title insurance and closing. I could bore you with some horror stories of what can happen if you don't have a real estate attorney involved in your deal, but I won't. I would just stress the fact that these stories are real but with me in your corner to guide you throughout the process they become practically non-existent.

I was in the middle of my first blog on my page when something happened to my connection and I lost about three paragraphs and have not re-posted. My blog was discussing the effect of Attorney General Jeff Session's Memo rescinding what is known as the "Cole" Memo, which has been around since 2013, that basically advised that the Department of Justice not pursue any cases against those medical cannabis businesses that were operating legally under their respective state law.

Many individuals and groups have reacted in different ways to this announcement. Some think it is a signal to federal prosecutors that they are now free to pursue those involved in the industry, while others state that there was no real policy shift as prosecutors still had discretion to prosecute even under the Cole memo.

As most everybody who reads this knows, cannabis remains illegal under federal law regardless of the laws that individual states enact so I always tell my cannabis clients that until the federal government actually legalizes cannabis nationally, there will always be the "threat" of prosecution. However, I personally do not think that this action by Sessions will have much of an impact upon the actual operations of legal cannabis businesses since federal enforcement against these businesses was never on the President's agenda.

I think we shall see what impact it actually has in the next few months should the federal government begin to bring cases against medical cannabis operators or those associated therewith. It will be interesting to see how those people in Ohio who are interested in getting involved in the legal medical cannabis industry will react now thinking that there has been a shift of policy which may instill fear in them and prevent them from doing something that they should never have to fear.

I am beginning to devote more of my practice to representing individuals and businesses who are seeking to become part of the legal medical cannabis industry in Ohio. I am also available to represent individuals who have been charged with a cannabis related criminal offense.

I have decided to dedicate more time to putting out useful information for people to consider in the real estate and business arenas as well as when planning their futures by having their estate plan in place. As most of you know, I concentrate my law practice on real estate matters such as contracts, title insurance and closings and also small business matters such as LLC's, partnerships, profit and non-profit corporations and all contracts and agreements related thereto.
