Today marks the 11th Year Anniversary of The DuBose Law Firm, LLC. 🍾🎊🎂🎉💐🥂

When I started TDLF, I had no idea that it would turn into the longest tenure of my legal career, which started in 2004—3.5 years as an Assistant Attorney General, 4.5 years as an Associate General Counsel, and 11 years as a solo practitioner.

Wow.

As a law school grad in 2004, TDLF wasn't my career dream, but 11 years later, it has made so many of my dreams come true. I am in absolute awe of what I have accomplished both personally and professionally because of TDLF, and for that I am truly GRATEFUL for each and every person who supported me on this journey.

THANK YOU.

And now, a new chapter begins. I am excited to announce that I, Shakeba DuBose, have been appointed by U.S. Department of Health and Human Services (HHS) Secretary Xavier Becerra to serve on the Centers for Medicare and Medicaid Services’ (CMS) Provider Reimbursement Review Board (PRRB) for the next 3 to 6 years in Baltimore, Maryland.

Wow.

A 24-year-old career aspiration (before law school) has finally come to fruition. And it would not have been possible without TDLF.

Ten years ago, the idea for TDLF popped into my head because I needed verifiable income to refinance my house. I had no desire to be an entrepreneur or solo practitioner. But, out of necessity, TDLF was created.

Representing and advising health care professionals over this past 10 years has presented its challenges as well as rewards.

Now, it's time to turn the page and start a new chapter: TDLF Dispute Resolution Services.

I am honored to announce that I've been selected as a new adjunct faculty member at my alma mater, the Maurer School of Law: Indiana University Bloomington. I will be teaching a new 4-week virtual course, Healthcare Law: Representing Clients in Legal and Compliance Matters, in January 2021.

The experiential course will introduce law students to healthcare law as it relates to representing clients in legal and compliance matters before state agencies and the court system. It will combine components of administrative law, regulatory compliance, and civil litigation. Throughout the course, students will assume the role of counsel and advise clients on the legal and/or compliance issues presented by their cases and/or represent them in legal actions.

I am excited to engage with the students and it is my goal to introduce them to various career paths and areas of healthcare law beyond those that typically come to mind (e.g., medical malpractice, class actions involving big pharma) and that they may not have considered as practice options at this stage in their academic careers (e.g., professional licensure defense, compliance officer, non-litigation/transactional work). And, by sharing some of my experiences throughout my career, I hope to illustrate that despite our best efforts for our clients, we do not always prevail, and that in my role as a hearing examiner, following the letter of the law sometimes is not in the best interests of those involved and how I have addressed issues under those circumstances.

The DuBose Law Firm would like to extend a sincere "THANK YOU" to all of the Columbus protesters (and those worldwide) who have rallied to speak out against racism and police brutality over the last few days. The bravery and persistence displayed by the protesters in the face of COVID-19 in addition to pepper spray, smoke bombs, and armed police is admirable, despite any other narratives that others focus on to deflect from the real problem--longstanding systemic, institutionalized and NORMALIZED RACISM in this country.

Also, "thank you" to the Columbus Police who, over the last two days, realized that joining and walking along with the protesters to show that they too are concerned about racism's impact on their service to the community works better than confronting them in riot gear and spraying non-threatening protesters directly in the face. When police officers make it clear to their brethren that racism and police brutality will no longer be tolerated, then we will begin to see real progress.

"Thank you" to the business owners who, despite incurring property damage, said, "That's what insurance is for" because they understand and empathize with the Black community whose lives are blatantly devalued by those in authority and power.

There is NO EXCUSE or RATIONALIZATION for the loss of LIFE, liberty, or the pursuit of happiness at the hands of racism in any form.

A week ago, on February 16, 2019, I received the Sam Dargan Award from my alma mater, the Maurer School of Law at Indiana University. I was given 2 minutes to make a speech. After thanking everyone for such an honor, I left the audience (including law students, professors, attorneys, judges, and others) with this:

"As we celebrate Black History Month and as we all observe what’s going on in our country and our world, I want to leave you with these three points to keep in mind as you progress in law school and your careers:

1) We, the barristers, have the utmost duty to develop, interpret, and uphold the laws of our country and to ensure that they are APPLIED EQUALLY TO ALL.

2) Everyone deserves and should be subject to equal treatment under the law NO MATTER WHO THEY ARE. We can either treat everyone based on how we treat the majority OR we can treat everyone based on how we treat the minority. But we must decide which, and IT SHOULD BE EQUAL. And finally,

3) Remember that we come from different backgrounds and our lives have been shaped by different experiences. And, there is NOTHING wrong with us being different. Our differences make us stronger and better able to improve our country and our world FOR ALL.

THANK YOU."

I can only hope that my words resonated with everyone.

On Monday, The DuBose Law Firm, LLC received great news that it prevailed in the defense of a $500,000 non-compete suit (including misappropriation and federal computer fraud & abuse act claims) against a physician client, which was initiated in federal court in September 2016, and successfully dismissed on the basis of forum non conveniens. In January 2018, the plaintiff refiled in state court and WITH NO DISCOVERY RESPONSES from plaintiff, TDLF PREVAILED on summary judgment.

Today, February 14, 2019, marks the 6th YEAR ANNIVERSARY of TDLF.

On Saturday, February 16, 2019, Shakeba will receive the Sam Dargan Award at her alma mater's annual Barrister's Ball.

Kicking off Black History Month, The DuBose Law Firm is proud to announce that its founder, Shakeba DuBose, has been selected as this year’s Samuel S. Dargan Award recipient by the Black Law Students Association at her alma mater, the Indiana University Maurer School of Law. She received the award in 2010 and 2012, and is absolutely humbled to have been selected again.

The award will be presented at the 2019 Barristers’ Ball.

“Samuel S. Dargan was the first African-American graduate of Indiana University School of Law. Dargan was a dedicated law librarian and active community member, who worked to expand educational and professional opportunities for African-Americans.

The legal profession afforded few opportunities to African-American lawyers in Dargan's day, and so he accepted the position of assistant law librarian at IU. From 1924 until his retirement in 1948, he held the position of Curator of Law. While working at the Law School, Dargan also operated a business selling law books to students. He was beloved by the law students, and his generosity and quiet dedication to the students earned him the title "father of the IU Law School."

With his Law School salary and the proceeds from his book business, Dargan purchased several properties on the west side of the IU campus. He operated several boarding houses for African-American students who were not permitted to occupy any university housing until after World War II. The Dargan House became the first residence for African-American women students, and his other houses served as social centers for Black students.

When Dargan retired in 1948, a group of law alumni honored him with a portrait in appreciation for "looking after us like a brother and a father." Dargan died in 1954 at the age of 84 and is buried in Bloomington’s Rose Hill Cemetery.

In 2018, the block of Indiana Ave. between 3rd Street and 4th Street (the block of Indiana Ave. that the law school sits on) was designated Samual Dargan Way.”
