If you are in PERS, SERS, STRS, Ohio Police & Fire, or any other public retirement system that has opted out of social security, this is big news. If this bill becomes law, p***c employees will get their state pension and their social security. Under the current law, if you have any of the Ohio retirement system pensions, and you also have enough years of contribution to social security, the wildly misnamed “Windfall Elimination Provison” significant reduces the amount of your social security benefit. With bipartisan sponsorship and support, this bill will improve the lives of our state workers, teachers, and all of the dedicated public servants who deserve their social security and state pensions.

Understanding the differences between divorce and dissolution in Ohio.

In Ohio, divorce and dissolution are the two primary methods for terminating a marriage. A marriage can be terminated with either method, but some significant distinctions will determine
the best method for you.

Ohio Dissolution:

In Ohio, a dissolution of marriage is only available when both parties can reach a full agreement on all property division and child-related issues.

Additional requirements for dissolution in Ohio:

1. Both parties must be present at the final hearing (which may be via video).

2. At least one party must have been a resident of Ohio for the 6 months preceding the case filing.

3. Each party waives service.

4. Both parties must make full disclosure of assets.

5. Ohio law states that the final hearing will be between the 30th day after filing and the 90th day after filing.

Ohio Divorce:

Where the parties are not able to reach an agreement, a divorce must be filed so the court can resolve the disputed portions of the case.

Additional requirements for divorce in Ohio:

1. The party that initiates the divorce must be a resident of Ohio for the 6 months preceding the filing of the case.

2. If the defendant does not live in Ohio, they must have sufficient minimum contacts with Ohio for the court to divide property or order support. If your spouse has never lived in Ohio and has never been to Ohio, the court cannot divide property or order support, but they can divide property.

3. With a divorce, you must allege (and sometimes prove) a specific ground.

4. The defendant must be served with a copy of the summons, complaint, and pleadings.

5. The plaintiff can get a divorce even if the defendant does not participate.

6. If the defendant does not participate, only the plaintiff makes full financial disclosure.

7. If the defendant is absent at the final hearing, the plaintiff must bring a witness to testify.

8. Ohio law states that you must wait at least 43 days from the date the defendant is served before the court can have a final hearing. Divorces without children can take up to one year, and divorces with children can take up to 18 months (although many are
resolved much faster).
