Just attended a webinar on Sports & Equity discussing the athletes ability to contract with third parties leveraging their name, image, and likeness as well as equity in sports regarding gender including female coaches. It was fascinating! If you've got a high school athlete looking to play at the next level, it's time to start educating yourself about your child's ability to manage their brand. There are issues you should start considering now.

Great news: the U.S. Supreme Court ruled today that Title VII of the Civil Rights Act of 1964 makes it illegal for employers to discriminate on the basis of s*x includes making it illegal to discriminate based on s*xual orientation or s*xual identity. The City of Columbus has long protected employees from discrimination based upon s*xual orientation and recently other communities have done likewise including Westerville.
I've had several cases in the past representing men who were s*xually harassed and retaliated against on the basis of s*xual orientation.
This is a huge win because there no longer is any grey area about whether the Federal Courts will apply the correct interpretation of "on the basis of s*x" from the 1964 act where it applies to orientation and gender identity.

Because of a split between circuits, the U.S. Supreme Court is taking up a trio of cases to address whether Title VII of the Civil Rights Act of 1964 which prohibits discrimination on the basis of s*x, encompasses s*xual orientation and gender identity. I'm hopeful that the court will agree with our own 6th Circuit Court of Appeals which declared that it is "analytically impossible" not to take into account a person's s*x when deciding whether to fire him or her for being transgender. For the past several years, the EEOC has supported the expanded interpretation to protect s*xual orientation and gender identity. The City of Columbus for many years has included s*xual orientation as a protected class in their anti-discrimination code.

Harvey Weinstein, Charlie Rose, Matt Lauer...employers are finally demonstrating zero tolerance of s*xual harassment by those at the highest levels of the organization. I've handled s*xual harassment cases for 18 years and have repeatedly watched employers protect harassers they deemed valuable to the organization. In most of the situations, the woman who complained was hung out to dry. It seems the tide is changing.

As someone who handles s*xual harassment cases, none of what is coming out about Harvey Weinstein surprises me. 1)These guys are predators who know how to pick their prey & the more powerful they are, the more every woman is prey; 2)It really is about power. They get off using their position to subordinate and degrade women in the most intimate way; 3)It always follows a pattern; and 4)If they've done it once, they have or will do it again. What kills me are the Hollywood types who are now publicly condemning him. This has been well known considering the jokes I've heard at award shows referencing his casting couch. This is typically true: the more powerful or valuable you are to an employer, the more likely everyone looks the other way & the more likely a woman who complains will face retaliation.
